Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance on May 24, 2007,
applicable to workers of Best: Artex LLC, Highland, Illinois.
The notice was published in the Federal Register on June 7, 2007
(72 FR 31616).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the support activities of accounting and technical
services to an affiliate in West Point, Mississippi, producing
dyed and bleached fabric.
New information shows that following a change in ownership
in February 2007, Best: Artex LLC is currently known as Best
Textiles International Ltd. Workers separated from employment at
the subject firm had their wages reported under a separate
unemployment insurance (UI) tax account for Best Textiles
International Ltd.
Accordingly, the Department is amending this certification
to show that Best: Artex LLC is currently known as Best Textiles
International Ltd.
The intent of the Department’s certification is to include
all workers of Best: Artex LLC, currently known as Best Textiles
International Ltd. who were adversely affected by a shift in
production to Cambodia.
The amended notice applicable to TA-W-61,393 is hereby issued
as follows:
"All workers of Best: Artex LLC, currently known as Best
Textiles International Ltd., Highland, Illinois, who became
totally or partially separated from employment on or after
April 26, 2006, through May 24, 2009, are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974, and are also eligible to apply for alternative
trade adjustment assistance under Section 246 of the Trade
Act of 1974.”

Certification Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results of
its investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on April 30, 2007 in response
to a petition filed on behalf of workers of Best: Artex LLC,
Highland, Illinois. Workers at the subject firm are engaged in
support activities in the capacity of accounting and technical
services to an affiliate in West Point, Mississippi.
The investigation revealed a decline in employment comparing
the period of April 26, 2007 to the period one year prior.
The investigation revealed that Best: Artex West Point is
shifting its dying and bleaching of fabric operation from West
Point, Mississippi to Cambodia.
Moreover, company imports of dyed and bleached fabric have
increased during the relevant period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from Best: Artex West Point, West Point, Mississippi to a foreign
country of articles that are like or directly competitive with
those produced by Best: Artex West Point, West Point, Mississippi,
and there has been or is likely to be an increase in imports of
like or directly competitive articles. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Best: Artex LLC, Highland, Illinois who became
totally or partially separated from employment on or after
April 26, 2006 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
