Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance And
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(B) of Section 222 have been met.
The investigation was initiated on March 9, 2007 in
response to a petition filed by the Laborer's Union, Local 1214
on behalf of workers of Haz-Waste Inc., working onsite at
Continental Tire North America, Inc. (CTNA), a subsidiary of
Continental AG, Mayfield, Kentucky. The workers at the subject
firm handled the recycling and disposal of tire waste onsite at
a tire producing facility.
The investigation revealed that workers of Haz-Waste Inc.
were contracted to handle recycling and disposal of tire waste
on-site at Continental Tire North America, Inc. (CTNA), a
subsidiary of Continental AG, Mayfield, Kentucky. Workers of
Continental Tire North America, Inc. (CTNA), a subsidiary of
Continental AG, Mayfield, Kentucky, are certified eligible to
apply for trade adjustment assistance under petition number TA-
W-57,520, which expires on August 9, 2007.
The investigation revealed that the number of employees of
Haz-Waste Inc. working at the tire production facility declined
from March 2006 to March 2007. The decline is employment is
directly related to the shift in production of tires from
Continental Tire North America, Inc. (CTNA), a subsidiary of
Continental AG, Mayfield, Kentucky to Mexico.
In addition, in accordance with Section 246 the Trade Act
of 1974 (26 USC 2813), as amended, the Department of Labor
herein presents the results of its investigation regarding
certification of eligibility to apply for alternative trade
adjustment assistance (ATAA) for older workers.
Since the workers of Continental Tire North America, Inc.
(CTNA), a subsidiary of Continental AG in Mayfield, Kentucky,
are certified eligible to apply for ATAA, the Department is
extending that eligibility to the employees of Haz-Waste Inc.
working at the Continental tire production facility in Mayfield.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that there was a shift of production
to Mexico of tires like or directly competitive with those
produced by Continental Tire North America, Inc. (CTNA), a
subsidiary of Continental AG, Mayfield, Kentucky. In accordance
with the provisions of the Act, I make the following
certification:


"All workers of Haz-Waste Inc., working onsite at Continental
Tire North America, Inc. (CTNA), a subsidiary of Continental AG,
Mayfield, Kentucky, who became totally or partially separated
from employment on or after March 8, 2006, through two years
from the date of certification, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.
