Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on March 29, 2007,
applicable to workers of US Global Flag LLC, Inc., Paterson, New
Jersey. The notice was published in the Federal Register on
April 10, 2007 (72 FR 17937).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of men’s trousers and short
trousers and women’s trousers and short skirts and jacket linings
and bedding.
New information shows that following a corporate decision,
workers separated from employment at the subject firm had their
wages reported under a separate unemployment insurance (UI) tax
account for Thorn, Inc., a companion company.
Accordingly, the Department is amending the certification to
properly reflect this matter.
The intent of the Department’s certification is to include
all workers of US Global Flag LLC, Inc., Paterson, New Jersey who
were adversely affected by increased company imports.
The amended notice applicable to TA-W-60,940 is hereby
issued as follows:
"All workers of US Global Flag LLC, Inc., including
workers paid by Thorn, Inc., Paterson, New Jersey, who
became totally or partially separated from employment
on or after January 31, 2006, through March 29, 2009,
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on February 12, 2007 in
response to a petition filed by the UNITE HERE Representative on
behalf of workers of US Global Flag LLC, INC., Paterson, New
Jersey. Workers at the subject firm produced men’s trousers and
short trousers and women’s trousers and short skirts and jacket
linings and bedding.
The investigation revealed that employment, sales, and
production at the subject firm decreased during the relevant
period.
The Department of Labor obtained aggregate data regarding
men’s and boys’ trousers, women’s slacks, and skirts. The ratio of
United States imports to domestic shipments for each of these items
was far in excess of 100 percent in 2006. In addition, aggregate
U.S. imports, expressed in quantity, of men’s and boys’ trousers,
and of women’s and girls slacks, comprised of man-made fiber,
increased in the full year ending February, 2007 compared with the
same period one year earlier. Imports of skirts, also of man-made
fiber, increased in calendar 2006 compared with 2005.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with those produced by US Global Flag
LLC, INC., Paterson, New Jersey, contributed to the total or
partial separation of workers and to the decline in sales or
production and at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers at US Global Flag LLC, INC., Paterson, New
Jersey, who became totally or partially separated from
employment on or after January 31, 2006 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”
