Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance on January 26, 2007,
applicable to workers of Riley Creek Lumber Company, Moyie
Springs Mill, including on-site leased workers from Industrial
Personnel, Moyie Springs, Idaho. The notice was published in the
Federal Register on February 14, 2007 (72 FR 7087).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of stud lumber.
The company reports that after an October 2008 merger,
Riley Creek Lumber Company, Moyie Springs Mill is currently known
as Idaho Forest Group.

Accordingly, the certification is being amended to include
workers at of the subject firm whose UI wages are reported under
the successor firm, Idaho Forest Group, LLC, Moyie Springs,
Idaho.
The amended notice applicable to TA-W-60,612 is hereby
issued as follows:
"All workers of Riley Creek Lumber, Moyie Springs Mill,
currently known as Idaho Forest Group, LLC, including on-
site leased workers from Industrial Personnel, Moyie
Springs, Idaho, who became totally or partially separated
from employment on or after December 13, 2005, through
January 26, 2009, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and
are also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on December 15, 2006 in
response to a petition on behalf of workers of Riley Creek Lumber
Company, Moyie Springs Mill, Moyie Springs, Idaho. Workers produce
stud lumber.
The subject firm also, occasionally, leases some workers from
Industrial Personnel.
Employment declined comparing January through November 2006
with the same period in 2005.
Sales declined during the same period as well.
The Department of Labor conducted a sample survey of the
subject firm’s major declining customers regarding their purchases
of lumber in 2004, 2005, and January through November 2006. This
survey revealed increased reliance of imported lumber during the
relevant period.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over and do not possess skills that
are easily transferable. Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with lumber produced at Riley Creek
Lumber Company, Moyie Springs Mill, Moyie Springs, Idaho,
contributed importantly to the total or partial separation of
workers at the subject firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Riley Creek Lumber Company, Moyie Springs
Mill, including on-site leased workers from Industrial
Personnel, Moyie Springs, Idaho, who became totally or
partially separated from employment on or after December 13,
2005 through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
