Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on December 12, 2006,
applicable to workers of Hardwick Knitted Fabrics, Inc., West
Warren, Massachusetts. The notice was published in the Federal
Register on December 27, 2006 (71 FR 77800-77802).
The Department, on its own motion, reviewed the
certification for workers of the subject firm. The workers of
the firm in West Warren, Massachusetts produced circular knit
fabric. Hardwick Knitted Fabrics, Inc. had a sales office in New
York, New York, but no affiliates or subsidiaries. Workers
marketing the firm’s production of circular knit fabric at the
New York, New York location were separated from employment.
The intent of the Department’s certification is to include
all workers of Hardwick Knitted Fabrics, Inc. who were
secondarily affected by a loss of business with a primary firm.
Based on this information, the Department is amending the
certification to extend worker adjustment assistance eligibility
to the workers of Hardwick Knitted Fabrics, Inc., New York, New
York.
With respect to alternative trade adjustment assistance
eligibility, the workers of the firm in New York, New York
possess skills that are easily transferable in the local area.
Therefore, workers of the firm in New York, New York, cannot be
certified eligible to apply for alternative trade adjustment
assistance.
The amended notice applicable to TA-W-60,526 is hereby
issued as follows:
"All workers of Hardwick Knitted Fabrics, West Warren,
Massachusetts (TA-W-60,526), who became totally or partially
separated from employment on or after November 30, 2005
through December 12, 2008, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act;”
and

“All workers of Hardwick Knitted Fabrics, Inc., New York,
New York (TA-W-60,526A), who became totally or partially
separated from employment on or after November 30, 2005
through December 12, 2008, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974;”
and
I further determine that all workers of Hardwick Knitted
Fabrics, Inc., New York, New York (TA-W-60,526A), are denied
eligibility to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.
Signed at Washington, D.C., this 24th day of January 2007.

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on December 4, 2006 in
response to a petition filed by a company official on behalf of
workers of Hardwick Knitted Fabrics, West Warren, Massachusetts.
The workers at the subject facility produce circular knitted
fabrics.

The investigation revealed that employment at the subject
facility declined in January through October 2006 compared with
2005.
The investigation also revealed that Hardwick Knitted Fabrics,
West Warren, Massachusetts supplied circular knitted fabric used in
furniture slipcovers, and a loss of business with a manufacturer of
furniture slipcovers, whose workers were certified eligible to
apply for adjustment assistance, contributed importantly to the
separation or threat of separation of workers at Hardwick Knitted
Fabrics, West Warren, Massachusetts.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers at Hardwick Knitted
Fabrics, West Warren, Massachusetts qualify as adversely affected
secondary workers under Section 222 of the Trade Act of 1974, as
amended. In accordance with the provisions of the Act, I make the
following certification:
“All workers of Hardwick Knitted Fabrics, West Warren,
Massachusetts who became totally or partially separated from
employment on or after November 30, 2005 through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974.”
