Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on November 16, 2006,
applicable to workers of Rice Mills, Incorporated, Belton, South
Carolina. The notice was published in the Federal Register on
November 28, 2006 (71 FR 68840).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of kid’s and adults’ sleepwear.
New findings show that there was a previous certification,
TA-W-54,637, issued on May 4, 2004, covering the identical worker
group as the subject firm, who were engaged in employment related
to the production of kid’s and adults’ sleepwear. That
certification expired on May 4, 2006. To avoid an overlap in
worker group coverage, the certification is being amended to
change the impact date from October 23, 2005 to May 5, 2006, for
workers of the subject firm.
The amended notice applicable to TA-W-60,353 is hereby
issued as follows:
"All workers of Rice Mills, Incorporated, Belton, South
Carolina, who became totally or partially separated from
employment on or after May 5, 2006, through November 16,
2008, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974 and are also eligible
to apply for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on November 1, 2006 in
response to a petition filed by a company official on behalf of
workers of Rice Mills Incorporated, Belton, South Carolina. The
workers produce kids’ and adults’ sleepwear.
The investigation revealed that employment and production at
the subject facility declined during the relevant period.
The investigation revealed that Rice Mills Incorporated,
Belton, South Carolina, increased their reliance on imported kids’
and adults’ sleepwear during the relevant period.
The investigation also revealed that the ratio of aggregate
U.S. imports of pajamas, nightwear, and other nightwear increased
significantly during the twelve month period ended June 2006 period
over the corresponding twelve month period ended June 2005 period.
Also, the ratio of aggregate U.S. imports to U.S. shipments during
the twelve month period ending June 2006 was over 3400 percent.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.






Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with kids’ and adults’ sleepwear
produced by Rice Mills Incorporated, Belton, South Carolina,
contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make
the following certification:
"All workers of Rice Mills Incorporated, Belton, South
Carolina, who became totally or partially separated from
employment on or after October 23, 2005 through two years from
the date of certification, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”
