Certification Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Negative Determination Regarding Eligibility To Apply For
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on October 13, 2006 in
response to a petition filed by a company official on behalf of
workers at three Divisions of Oakwood Custom Coating Inc.: Oakwood
Energy Management Division, Taylor, Michigan (TA-W-60,243), Oakwood
Metal Fabricating Division, Taylor, Michigan (TA-W-60,243A), and
Oakwood Metal Fabricating Division, Dearborn Michigan (TA-W-
60,243B). The workers at Oakwood Energy Management division
produced plastic injection molded automotive interior trim while
workers in the Metal Fabricating Division, in both Taylor and
Dearborn, Michigan, provided work in support of production at
another Division of Oakwood Custom Coating: Oakwood Plastics
Division in Taylor, Michigan. This support includes finance,
engineering, and work done by process technicians and maintenance
technicians. Workers at all three petitioning facilities were
engaged in employment related to the production of plastic
injection molded automotive interior trim.
The Department of Labor conducted an investigation in relation
to the separation of workers at the Oakwood Plastics Division,
Taylor, Michigan. Those workers were certified eligible to apply
for TAA (TA-W-59,888) on September 12, 2006, and that investigation
also has relevance to workers at the Oakwood Energy Management
Division in Taylor. Workers at the Energy Management Division are
directly engaged in the production of like products, plastic
injection molded automotive interior trim, and produce at the same
location as the Oakwood Plastics Division. It was determined that
the requirements of (a)(2)(A) of Section 222 of the Trade Act were
met with regard to the Plastics Division, and the rationale for
that determination can apply as well to the workers of the Oakwood
Energy Management Division.
Workers separated from the Oakwood Energy Management
Division due to being "bumped" by separations related to the above
cited certification of the Plastics Division on September 12, 2006
are eligible to apply for adjustment assistance under that
certification.
With regard to the Oakwood Metal Fabricating Division, located
in both Taylor and Dearborn, Michigan, the investigation revealed
that some workers provided dedicated support to the Oakwood
Plastics Division, Taylor, Michigan, and were separated as a result
of the closure of the Plastics Division facility. As noted,
workers at the Oakwood Plastics Division, Taylor, Michigan, were
certified eligible to apply for TAA (TA-W-59,888) on September 12,
2006.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.


The group eligibility criteria for the ATAA program that the
Department must consider under Section 246 of the Trade Act are:
1. Whether a significant number of workers in the workers'
firm are 50 years of age or older.

2. Whether the workers in the workers' firm possess skills
that are not easily transferable.

3. The competitive conditions within the workers' industry
(i.e., conditions within the industry are adverse).

The Department has determined that criterion one has not been met.
The investigation revealed that the subject facility does not
have a significant number of workers who are age 50 or older.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with plastic injection molded
automotive interior trim produced at Oakwood Plastics Division,
Taylor, Michigan, contributed importantly to the total or partial
separation of workers and to the decline in sales or production at
those firms or subdivisions. In accordance with the provisions of
the Act, I make the following certification:


"All workers of Oakwood Custom Coating Inc., Oakwood Energy
Management Division, Taylor, Michigan (TA-W-60,243), and
certain workers of Oakwood Custom Coating Inc., Oakwood Metal
Fabricating Division, Taylor, Michigan (TA-W-60,243A), and
Oakwood Custom Coating Inc., Oakwood Metal Fabricating
Division, Dearborn, Michigan (TA-W-60,243B), who provided
dedicated support to Oakwood Plastics Division, Taylor,
Michigan, and who became totally or partially separated from
employment on or after October 12, 2005 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
I further determine that all workers of the above named
Divisions are denied eligibility to apply for alternative
trade adjustment assistance under Section 246 of the Trade Act
of 1974.
