Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on October 3, 2006,
applicable to workers of Owens-Brockway, Inc., Global Glass
Technologies Division, a division of Owens-Illinois, Inc.,
including on-site leased workers of Manpower, Inc., Godfrey,
Illinois. The notice was published in the Federal Register on
October 31, 2006 (71 FR 63800).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of machined parts for glass
forming machines.


New information shows that leased workers of Availability
were employed on-site at the Godfrey, Illinois location of Owens-
Brockway, Inc., Global Glass Technologies Div., a division of
Owens-Illinois, Inc.
Based on these findings, the Department is amending this
certification to include leased workers of Availability working
on-site at Owens-Brockway, Inc., Global Glass Technologies
Division, a division of Owens-Illinois, Inc., Godfrey, Illinois.
The intent of the Department’s certification is to include
all workers employed at Owens-Brockway, Inc., Global Glass
Technologies Division, a division of Owens-Illinois, Inc. who
were adversely affected by a shift in production to the United
Kingdom, Colombia, South America, Mexico and China.


The amended notice applicable to TA-W-60,136 is hereby
issued as follows:
"All workers of Owens-Brockway, Inc., Global Glass
Technologies Division, a division of Owens-Illinois,
including on-site leased workers of Manpower, Inc. and
Availability, Godfrey, Illinois, who became totally or
partially separated from employment on or after
September 25, 2005, through October 3, 2008, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on September 26, 2006 in
response to a petition filed by the International Association of
Machinist and Aerospace Workers on behalf of workers of Owens-
Brockway Inc., Global Glass Technologies Division, a division of
Owens-Illinois, Godfrey, Illinois. The workers produce machined
parts for glass forming machines.
The worker group includes on-site leased workers of Manpower
Inc.
The investigation revealed that employment at the subject
facility declined during the period of January through August 2006
compared with the same period in 2005.
Production of the machined parts is being shifted abroad,
including to a country (Colombia) that is a beneficiary country
under the Andean Trade Preference Act.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers firm or subdivision to Colombia of articles that
are like or directly competitive with those produced by the subject
firm or subdivision. In accordance with the provisions of the Act,
I make the following certification:



"All workers of Owens-Brockway Inc., Global Glass Technologies
Division, including on-sited leased workers from Manpower
Inc., a division of Owens-Illinois, Godfrey, Illinois who
became totally or partially separated from employment on or
after September 25, 2005 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.
