Amended Notice of Revised Determination
On Reconsideration

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Notice of
Revised Determination on Reconsideration on August 8, 2007. The
notice was published in the Federal Register on August 20, 2007
(72 FR 46515-46516). The Revised Determination on
Reconsideration was amended on January 30, 2009, July 8, 2009 and
August 26, 2009 to include on-site leased workers from Roush
Management LLC, Rapid Global Businesses Solutions, Inc., TAC
Automotive, MSX, New Dimension Group, and Kelly Services. The
notices were published in the Federal Register on February 13,
2009 (74 FR 7269), July 14, 2009 (74 FR 34043) and September 22,
2009 (74 FR 48314-48315) respectively.
At the request of the State agency, the Department reviewed
the Notice of Revised Determination on Reconsideration for
workers of the subject firm. The workers are in direct support
of production of numerous assembly plants of Ford Motor Company
whose workers were certified eligible to apply for adjustment
assistance.
New information shows that workers leased workers from TEK
Systems were employed on-site at the Dearborn, Michigan location
of Ford Motor Company, Product Development Center. The
Department has determined that these workers were sufficiently
under the control of the subject firm to be considered leased
workers.
Based on these findings, the Department is amending this
revised determination to include workers leased from TEK Systems
working on-site at the Dearborn, Michigan location of the subject
firm.
The intent of the Department’s certification is to include
all workers employed at Ford Motor Company, Product Development
and Engineering Center, Dearborn, Michigan who were adversely
affected by increased imports.


The amended notice applicable to TA-W-60,086 is hereby
issued as follows:
"All workers of Ford Motor Company, Product Development
and Engineering Center, including on-site leased
workers from Roush Management LLC, Rapid Global
Business Solutions, Inc., TAC Automotive, MSX, New
Dimension Group, Kelly Services and TEK Systems,
Dearborn, Michigan, who became totally or partially
separated from employment on or after September 14,
2005, through August 8, 2009, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Dearborn, Michigan location of the subject firm.
The intent of the Department’s certification is to include
all workers employed at Ford Motor Company, Product Development
and Engineering Center, Dearborn, Michigan who were adversely
affected by increased imports.


The amended notice applicable to TA-W-60,086 is hereby
issued as follows:
"All workers of Ford Motor Company, Product Development
and Engineering Center, including on-site leased

Based on these findings, the Department is amending this
revised determination to include workers leased from Rapid Global
Business Solutions, Inc., and TAC Automotive working on-site at
the Dearborn, Michigan location of the subject firm.
The intent of the Department’s certification is to include
all workers employed at Ford Motor Company, Product Development
and Engineering Center, Dearborn, Michigan who were adversely
affected by increased imports.


The amended notice applicable to TA-W-60,086 is hereby
issued as follows:
"All workers of Ford Motor Company, Product Development
and Engineering Center, including on-site leased

Notice of Revised Determination
on Reconsideration

On May 24, 2007, the Department issued an Affirmative
Determination Regarding Application on Reconsideration applicable
to workers and former workers of the subject firm. The notice
was published in the Federal Register on May 30, 2007 (72 FR
30030).
The previous investigation initiated on September 14, 2006,
resulted in a negative determination issued on March 15, 2007,
was based on the finding that the subject worker group did not
directly support production at the subject firm. The denial
notice was published in the Federal Register on March 30, 2007
(72 FR 15168).
In the request for reconsideration the petitioners allege
that the petitioning group of workers was in direct support of
manufacturing and assembly of Ford automobiles at various Ford
Motor Company manufacturing facilities.
A company official was contacted to verify whether workers
at the subject facility were supporting production at Ford Motor
Company manufacturing facilities. The company official stated
that workers of the subject facilities were in direct support of
production at Ford Motor Company Atlanta Assembly Plant,
Hapeville, Georgia (TA-W- 59017), Ford Motor Company Norfolk
Assembly Plant, Norfolk, Virginia (TA-W- 60,367), Ford Motors
Company Twin Cities Assembly Plant, St. Paul, Minnesota (TA-W-
60,435), and Ford Motor Company St. Louis Assembly Plant,
Hazelwood, Missouri, (TA-W-60,478) during the relevant period.
All of the above mentioned production facilities were certified
eligible for adjustment assistance during April through December
2006.
The investigation further revealed that employment at the
subject firm declined during the relevant period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of
eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or
over and possess skills that are not easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with articles produced by Ford Motor
Company contributed importantly to the total or partial separation
of workers at the subject firm and to the decline in sales or
production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Ford Motor Company, Product Development and
Engineering Center, Dearborn, Michigan, who became totally
or partially separated from employment on or after September
14, 2005, through two years from the date of this
certification, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and
are eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."

Notice of Affirmative Determination
Regarding Application for Reconsideration

By letter dated April 15, 2007, three workers requested
administrative reconsideration by the Department of Labor
(Department) of the Department’s Notice of Negative Determination
Regarding Eligibility to Apply for Worker Adjustment Assistance,
applicable to workers and former workers of the subject firm.
The negative determination was issued on March 15, 2007. The
Department’s Notice of determination was published in the Federal
Register on March 30, 2007 (72 FR 15168). The subject worker
group performed product development and engineering services.
The determination states that “In order to be considered
eligible to apply for adjustment assistance under Section 223 of
the Trade Act, the worker group seeking certification (or on
whose behalf certification is being sought) must work for a
“firm” or appropriate subdivision that produces an article
domestically and there must be a relationship between the
workers’ work and the article produced by the workers’ firm or
appropriate subdivision.” The negative determination was based
on the Department’s findings that the subject worker group did
not directly support subject firm production.

In the request for reconsideration, the workers alleged that
the subject worker group directly supported domestic production
of automobiles produced by Ford Motor Company.
The Department has carefully reviewed the workers’ request
for reconsideration and the existing record, and has determined
that an administrative review is appropriate.
Conclusion
After careful review of the application, I conclude that the
claim is of sufficient weight to justify reconsideration of the
U.S. Department of Labor's prior decision. The application is,
therefore, granted.

Negative Determination Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
The investigation was initiated on September 14, 2006, in
response to a petition filed on behalf of workers of Ford Motor
Company, Product Development and Engineering Center, Dearborn,
Michigan. The workers performed product development and
engineering services at Ford’s Product Development and Engineering
Center.
The investigation determined that employees in Ford’s Product
Development and Engineering Center business organization are
engaged in support and enhancement of existing product lines, as
well as the development of new vehicle lines. They provide direct
engineering support to various car and truck programs, not the
manufacturing arm of the firm.
In order to be considered eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, the worker
group seeking certification (or on whose behalf certification is
being sought) must work for a "firm" or appropriate subdivision
that produces an article domestically and there must be a
relationship between the workers' work and the article produced by
the workers' firm or appropriate subdivision. The investigation
revealed that although production of an article(s) occurred within
the firm, the product development workers described above do not
directly support this production. Thus, the worker group cannot be
considered import impacted or affected by a shift in production of
an article.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the worker group must be certified
eligible to apply for trade adjustment assistance (TAA). Since the
workers are denied eligibility to apply for TAA, the workers cannot
be certified eligible for ATAA.

Conclusion
After careful review of the facts obtained in the
investigation, I determine that all workers of Ford Motor Company,
Product Development and Engineering Center, Dearborn, Michigan are
denied eligibility to apply for adjustment assistance under Section
223 of the Trade Act of 1974, and are also denied eligibility to
apply for alternative trade adjustment assistance under Section 246
of the Trade Act of 1974.
