Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on May 1, 2006, in response to
a petition filed by a company official on behalf of workers of
Paxar Americas, Inc., a subsidiary of Paxar Corporation, Woven
Division, Weston, West Virginia (TA-W-59,311) and Paxar Americas,
Inc., a subsidiary of Paxar Corporation, Printed Division, Lenoir,
North Carolina (TA-W-59,311A).
Workers of Paxar Americas, Inc., a subsidiary of Paxar
Corporation, Woven Division, Weston, West Virginia (TA-W-59,311)
produce woven labels for apparel identification. Workers of Paxar
Americas, Inc., a subsidiary of Paxar Corporation, Printed
Division, Lenoir, North Carolina (TA-W-59,311A) produce printed
fabric labels for apparel identification.

The preponderance in the declines in employment at the subject
facility is related to a shift in production of woven labels for
apparel identification to a country (Mexico) that is a party to a
free trade agreement with the United States and to Honduras, a
country that is a beneficiary country under the Caribbean Basin
Economic Recovery Act.
The investigation revealed that Paxar Americas, Inc., a
subsidiary of Paxar Corporation, Woven Division, Weston, West
Virginia (TA-W-59,311) also leased workers on-site from Manpower to
produce woven labels for apparel identification.

The investigation revealed that sales and production at the
subject firm declined during January through April 2006 over the
corresponding 2005 period. The company is currently experiencing
employment declines.
The investigation further revealed that the subject firm
increased imports of printed fabric labels for apparel
identification during January through April 2006 over the
corresponding 2005 period.
The investigation revealed that Paxar Americas, Inc., a
subsidiary of Paxar Corporation, Printed Division, Lenoir, North
Carolina (TA-W-59,311A) also leased workers on-site from Foothills
Temporary to produce printed fabric labels for apparel
identification.
In addition, in accordance with Section 246 of the Trade Act
of 1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for Alternative Trade Adjustment Assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the Paxar Americas, Inc., a
subsidiary of Paxar Corporation, Woven Division, Weston, West
Virginia (TA-W-59,311) and Paxar Americas, Inc., a subsidiary of
Paxar Corporation, Printed Division, Lenoir, North Carolina (TA-W-
59,311A) are age 50 or over and possess skills that are not easily
transferable. Competitive conditions within the industry are
adverse.
The investigation further revealed that workers of Paxar
Americas, Inc., Lenoir, North Carolina were under an existing
certification for TAA and ATAA which expired on September 23, 2005.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with woven labels for apparel
identification produced at Paxar Americas, Inc., a subsidiary of
Paxar Corporation, Woven Division, Weston, West Virginia (TA-W-
59,311) contributed importantly to the total or partial separation
of workers and to the decline in sales or production at that
facility. Moreover, I determine that there was a shift in
production from Paxar Americas, Inc., a subsidiary of Paxar
Corporation, Printed Division, Lenoir, North Carolina (TA-W-
59,311A) to Mexico and Honduras of articles that are like or
directly competitive with the printed fabric labels for apparel
identification produced by the subject facility or subdivision. In
accordance with the provisions of the Act, I make the following
certification:





"All workers of Paxar Americas, Inc., a subsidiary of Paxar
Corporation, Woven Division, including on-site leased workers
of Manpower, Weston, West Virginia (TA-W-59,311) who became
totally or partially separated from employment on or after
April 28, 2005 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974 and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974" and
"All workers of Paxar Americas, Inc., a subsidiary of Paxar
Corporation, Printed Division, including leased workers of
Foothills Temporary, Lenoir, North Carolina (TA-W-59,311A) who
became totally or partially separated from employment on or
after September 24, 2005 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974 and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974."
