Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance on March 29, 2006,
applicable to workers of Fraser Paper LLC, Berlin, New Hampshire.
The notice will be published soon in the Federal Register.
Workers at the Berlin, New Hampshire location produce paper
pulp that is used by the workers at the Gorham, New Hampshire
location to produce fine paper and towel paper.
New information provided by the company shows that workers
are sent back and forth between the Berlin, New Hampshire
facility and the Gorham, New Hampshire facility; therefore,
workers are not separately identifiable by product line or by
location. The two facilities essentially worked as one unit via
a two mile pipeline connecting the facilities. Worker
separations have occurred at both the Berlin, New Hampshire and
Gorham, New Hampshire facilities of Fraser NH LLC.
Accordingly, the Department is amending the certification to
also cover workers of the Gorham, New Hampshire location of
Fraser NH LLC and to correct the name of the subject firm from
Fraser Paper, L.L.C. to read Fraser NH LLC.
The intent of the Department’s certification is to include
all workers of Fraser NH LLC who were adversely affected by
increased company imports.
The amended notice applicable to TA-W-59,031 is hereby
issued as follows:
"All workers of Fraser NH LLC, Berlin, New Hampshire
and Fraser NH LLC, Gorham, New Hampshire, who became
totally or partially separated from employment on or
after March 14, 2005, through March 29, 2008, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974 and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on March 15, 2006, in response
to a petition filed by United Steelworkers of America Local 75 on
behalf of workers of Fraser Paper L.L.C., Berlin, New Hampshire.
The workers produce paper pulp.
The investigation revealed that the subject firm has
experienced declines in sales, production and employment during the
relevant time period.
The investigation also revealed that the subject firm
increased its imports paper pulp during the relevant time period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with paper pulp produced at Fraser
Paper L.L.C., Berlin, New Hampshire, contributed importantly to the
total or partial separation of workers and to the decline in sales
or production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:


"All workers of Fraser Paper L.L.C., Berlin, New Hampshire,
who became totally or partially separated from employment on
or after March 14, 2005, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and I further
determine that all workers of Fraser Paper L.L.C., Berlin, New
Hampshire, are certified eligibile to apply for alternative
trade adjustment assistance under Section 246 of the Trade Act
of 1974.”
