Amended Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on March 21, 2006,
applicable to workers of Panasonic Shikoku Electronics
Corporation of America (PSECA), Vancouver, Washington. The
notice was published in the Federal Register on April 12, 2006
(71 FR 18771).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
assemble combination and rear projection televisions (includes
DVD/VCR) and act in a support capacity for sales and purchasing.
New information shows that leased workers from Express
Personnel Services were employed on-site at the Vancouver,
Washington location of Panasonic Shikoku Electronics Corporation
of America (PSECA). The Department has determined that these
workers were sufficiently under the control of the subject firm.
Based on these findings, the Department is amending this
certification to include leased workers from Express Personnel
Services working on-site at the Vancouver, Washington location of
the subject firm.
The intent of the Department’s certification is to include
all workers employed at Panasonic Shikoku Electronics Corporation
of America (PSECA) who were adversely affected by increased
imports.


The amended notice applicable to TA-W-58,807 is hereby
issued as follows:
"All workers of Panasonic Shikoku Electronic
Corporation of America (PSECA), including on-site
leased workers from Express Personnel Services,
Vancouver, Washington, who became totally or partially
separated from employment on or after February 7, 2005,
through March 21, 2008, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on February 9, 2006 in
response to a petition filed by a company official on behalf of
workers of Panasonic Shikoku Electronic Corporation of America
(PSECA), Vancouver, Washington (TA-W-58,807) and Panasonic Shikoku
Electronic Sales of America, LLC (PSECSA), Portland, Oregon (TA-W-
58,807A). Workers at the subject firms assemble combination and
rear projection televisions (includes DVD/VCR) and act in a support
capacity for sales and purchasing respectively.
The investigation revealed a significant number or proportion
of workers at the subject firms are threatened to become separated
from employment.
Furthermore, the investigation revealed that sales and
production at the Vancouver, Washington location (TA-W-58,807)
decreased from 2004 to 2005.
The Department of Labor surveyed Vancouver, Washington’s (TA-
W-58,807) major declining customers regarding their purchases of
combination and rear projection televisions (DVD/VCR). This survey
revealed increased imports of combination and rear projection
televisions (DVD/VCR) during the relevant period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
The group eligibility criteria for the ATAA program

that the Department must consider under Section 246 of the

Trade Act are:
1. Whether a significant number of workers in the
workers' firm are 50 years of age or older.
2. Whether the workers in the workers' firm possess skills
that are not easily transferable.
3. The competitive conditions within the workers' industry
(i.e., conditions within the industry are adverse).

In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met for Panasonic Shikoku Electronic Corporation of America
(PSECA), Vancouver, Washington (TA-W-58,807).
A significant number of workers at the firm are age 50 or over
and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.
Furthermore, The Department has determined that criterion 1
has not been met for Panasonic Shikoku Electronic Sales of America,
LLC (PSECSA), Portland, Oregon.
The investigation revealed that a significant number of
workers in the workers’ firm are not 50 years of age or older.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with combination and rear projection
televisions (DVD/VCR) produced by Panasonic Shikoku Electronic
Corporation of America (PSECA), Vancouver, Washington (TA-W-58,807)
contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make
the following certification:
"All workers of Panasonic Shikoku Electronic Corporation of
America (PSECA), Vancouver, Washington who became totally or
partially separated from employment on or after February 7,
2005 through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
“All workers of Panasonic Shikoku Electronic Sales of America,
LLC (PSECSA), Portland, Oregon (TA-W-58,807A) who became
totally or partially separated from employment on or after
February 7, 2005 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974;” and


I further determine that all workers of Panasonic Shikoku
Electronic Sales of America, LLC (PSECSA), Portland, Oregon (TA-W-
58,807A) are denied eligibility to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of 1974.
