Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results of
its investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
With regards to workers at Five Rivers Electronic Innovations
LLC, Color Televisions Product Line, Plastic Parts Color Line, and
Distribution/Warehouse Center, Greeneville, Tennessee, it is
determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on January 12, 2006 in
response to a petition filed by the International Union of
Electronic, Electrical, Salaried, Machine and Furniture Workers-
Communications Workers of America, Local 796, on behalf of workers
of Five Rivers Electronic Innovations LLC, Color Televisions
Product Line (TA-W-58,628), Plastic Parts Product Line (TA-W-
58,628A), and Distribution/Warehouse Center (TA-W-58,628B), all
located in Greeneville, Tennessee. The workers in the Color
Televisions Product Line are engaged in the production of
televisions; those in the Plastic Parts Product Line manufacture
plastic parts for creative molding. Workers at the
Distribution/Warehouse Center are engaged in the stocking and
distributing of products manufactured by both of the manufacturing
facilities.
The subject firm was certified for trade adjustment assistance
on October 1, 2003 (case number TA-W-52,623). That certification
expired October 1, 2005.
This investigation revealed that employment, sales, and
production at the subject firm will decrease absolutely upon its
expected shutdown on February 28, 2006.
The Department of Labor surveyed the subject firm's major
customers of both color televisions and plastic parts for
televisions for the 2004 and 2005 periods. The surveys revealed
substantial increases in imports of both products accompanied by a
decline in purchases from the subject firm.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in this case that the
requirements of Section 246 have been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable to positions
with similar pay and benefits. Furthermore, competitive conditions
within the industry are adverse
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with those manufactured at Five Rivers
Electronic Innovations LLC, Greeneville, Tennessee contributed to
the total or partial separation of workers and to the decline in
sales or production at that firm or subdivision. In accordance
with the provisions of the Act, I make the following certification:


"All workers of Five Rivers Electronic Innovations LLC, Color
Televisions Product Line, (TA-W-58,628), Plastic Parts Product
Line (TA-W-58,628A), and Distribution/Warehouse Center (TA-W-
58,628B), all located in Greeneville, Tennessee, who became
totally or partially separated from employment on or after
October 2, 2005, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974."
