Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Notice of
Determination Regarding Eligibility to Apply for Worker
Adjustment Assistance on February 21, 2006, applicable to workers
of WestPoint Home, Inc., formerly WestPoint Stevens, Inc., Sales
and Marketing Office, New York, New York. The notice was
published in the Federal Register on March 22, 2006 (71 FR
14549).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm.
New information shows that a worker separation has occurred
involving an employee of the Sales and Marketing Office, New
York, New York of WestPoint Home, Inc., formerly WestPoint
Stevens, Inc. located in Seneca, South Carolina. Mr. Gerry
Bednar provided various support services for the manufacture of
comforters, sheets, pillowcases, towels and blankets produced by
WestPoint Home, Inc., formerly WestPoint Stevens, Inc.
Based on these findings, the Department is amending this
certification to include an employee of the Sales and Marketing
Office New York, New York facility of WestPoint Home, Inc.,
formerly WestPoint Stevens, Inc. located in Seneca, South
Carolina.
The intent of the Department’s certification is to include
all workers of WestPoint Home, Inc., formerly WestPoint Stevens,
Inc., Sales and Marketing Office, New York, New York who were
adversely affected by increased company and customer imports.


The amended notice applicable to TA-W-58,623L is hereby
issued as follows:
"All workers of WestPoint Home, Inc., formerly
WestPoint Stevens, Inc., Sales and Marketing Office,
New York, New York (TA-W-58,623L), including an
employee reporting to this office but working in
Seneca, South Carolina (TA-W-58,623GG), who became
totally or partially separated from employment on or
after January 12, 2005, through February 21, 2008, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met, excluding certain locations under
existing TAA certification.
The investigation was initiated in response to a petition
received on January 12, 2006, and filed by the company on behalf of
workers at WestPoint Home, Inc., formerly WestPoint Stevens, Inc.,
Corporate Headquarters, West Point, Georgia (TA-W-58,623); Sales
and Marketing Office, New York, New York(TA-W-58,623L), and
Administrative Office, Clemson, South Carolina (TA-W-58,623Y). The
workers were engaged in activities related to the production of
comforters, sheets and pillowcases, towels, and blankets. A
complete listing of all work sites relating to this decision may be
found on the first and second page of this decision as depicted
(TA-W-58,623 and TA-W-58,623A through TA-W-58,623AA, including TA-
W-58,623AA).
The investigation revealed that all locations experienced
employments declines during the relevant period.
Employees at the subject locations were engaged in support
activities of numerous affiliated facilities whose workers are
under recent Trade Adjustment Assistance certification. Those
certifications were based on either increased company imports or
increased customer imports of comforters, sheet and pillowcases,
towels and blankets during the relevant period.
The investigation also revealed that there are existing
certifications for Trade Adjustment Assistance(TAA) and for
Alternative Trade Adjustment Assistance (ATAA) for workers at five
of the locations included in the petitions in this case: WestPoint
Home, Inc., formerly WestPoint Stevens, Inc., Biddeford Plant,
Biddeford, Maine (TA-W-58,623C); WestPoint Home, Inc., formerly
WestPoint Stevens, Inc., Daleville, Indiana (TA-W-58,623F and TA-W-
58,623O); WestPoint Home, Inc., formerly WestPoint Stevens, Inc.,
Longview Plant, Hickory, North Carolina (TA-W-58,623G); WestPoint
Home, Inc., formerly WestPoint Stevens, Inc., Middletown, Indiana
(TA-W-58,623R); and WestPoint Home, Inc., formerly WestPoint
Stevens, Inc., Calhoun Plant, Calhoun Falls, South Carolina (TA-W-
58,623AA). Since these workers are under existing TAA and ATAA
certifications, they can not be certified for eligibility under the
current petition.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers, excluding certain locations under existing ATAA
certification as specified above.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met, excluding those locations for which there are existing
ATAA certifications.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with comforters, sheets and
pillowcases, towels, and blankets produced at WestPoint Home, Inc.,
formerly WestPoint Stevens, Inc., contributed importantly to the
total or partial separation of workers and to the decline in sales
or production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of WestPoint Home, Inc., formerly WestPoint
Stevens, Inc., Corporate Headquarters, West Point, Georgia
(TA-W-58,623), including employees reporting to this office
but working at: Management Information Center, West Point,
Georgia (TA-W-58,623A); Abbeville, Alabama (TA-W-58,623B);
Alamance Division Office, Burlington, North Carolina (TA-W-
58,623D); Clemson Centre, Clemson, South Carolina (TA-W-
58,623E); Opelika Division Office, Opelika, Alabama (TA-W-

(TA-W-58,623C); WestPoint Home, Inc., formerly WestPoint Stevens,
Inc., Daleville, Indiana (TA-W-58,623F and TA-W-58,623O); WestPoint

Based on these findings, the Department is amending this
certification to include employees of the Sales and Marketing
Office New York, New York facility of WestPoint Home, Inc.,
formerly WestPoint Stevens, Inc. located in Malvern, Pennsylvania
and Santa Fe Springs, California.
The intent of the Department’s certification is to include
all workers of WestPoint Home, Inc., formerly WestPoint Stevens,
Inc., Sales and Marketing Office, New York, New York who were
adversely affected by increased company and customer imports.
