Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974, as amended
(19 USC 2813), the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on January 20, 2006,
applicable to workers of Visteon Systems LLC, Bedford, Indiana.
The notice was published in the Federal Register on February 3,
2006 (71 FR 5895).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
produce automotive components (fuel delivery modules, washer
reservoirs, and canister vent valves).
The Department inadvertently limited the certification to
workers engaged in employment related to the production that was
shifted from the Bedford, Indiana plant to Mexico, fuel delivery
modules. Since the workers are not separately identifiable by
product, the Department intended to include all workers of the
firm. Accordingly, the Department is amending the certification
to correct.
The amended notice applicable to TA-W-58,472 is hereby
issued as follows:
“All workers of Visteon Systems, LLC, Bedford, Indiana,
totally or partially separated from employment on or after
November 30, 2004, through January 20, 2008, are eligible to
apply for adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for alternative
trade adjustment assistance under Section 246 of the Trade Act
of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on December 7, 2005, in
response to a petition filed by the International Union of
Electronic, Electrical, Salaried, Machine, and Furniture Workers –
Communication Workers of America, Local 8 on behalf of workers of
Visteon Systems Inc., Bedford, Indiana. The workers at the subject
firm produce automotive components, namely fuel delivery modules,
washer reservoirs, and canister vent valves.
The preponderance in the declines in employment at the subject
firm is related to a shift in production of fuel delivery modules
to Mexico, a country that is party to a free trade agreement with
the United States.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in this case that the
requirements of Section 246 have been met.
A significant number of workers at the firm are age 50 or over
and do not possess skills that are easily transferable. Competitive
conditions within the industry are adverse.



Conclusion
After careful review of the facts obtained in the
investigation, I conclude that there has been a shift in production
from Visteon Systems Inc., Bedford, Indiana to Mexico of articles
that are like or directly competitive with fuel delivery moduels
produced by that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"Workers of Visteon Systems Inc., Bedford, Indiana engaged in
employment related to the production of fuel delivery modules
who became totally or partially separated from employment on
or after November 30, 2004, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
