Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Negative Determination Regarding Eligibility to Apply for
Alternative Trade Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
and a Negative Determination Regarding Eligibility to Apply for
Alternative Trade Adjustment Assistance on September 28, 2005,
applicable to workers of Sara Lee Branded Apparel, Division
Office, Winston-Salem, North Carolina. The notice was published
in the Federal Register on October 31, 2005 (70 FR 62347).
At the request of a petitioner and the State agency, the
Department reviewed the certification for workers of the subject
firm. New information shows that a worker separation occurred
involving an employee of the Division Office, Winston-Salem,
North Carolina facility of the Sara Lee Branded Apparel located
in Covington, Georgia. Ms. Charlene Gautier provided sales and
merchandizing support function services for the activities
related to the production of underwear (shorts and T-shirts)
produced by the subject company.
Based on these findings, the Department is amending this
certification to include an employee of the Division Office,
Winston-Salem, North Carolina facility of the Sara Lee Branded
Apparel located in Covington, Georgia.
The intent of the Department’s certification is to include
all workers of Sara Lee Branded Apparel, Division Office,
Winston-Salem, North Carolina who was adversely affected by
increased imports.


The amended notice applicable to TA-W-57,802 is hereby
issued as follows:
"All workers of Sara Lee Branded Apparel, Division
Office, Division of the Sara Lee Corporation, formerly
known as National Textiles, LLC, currently known as
Hanesbrands, Inc., Winston-Salem, North Carolina (TA-W-
57,802), and including an employee of Sara Lee Branded
Apparel, Division Office, Division of Sara Lee
Corporation, currently known as Hanesbrands, Inc.,
Winston Salem, North Carolina, located in Covington,
Georgia (TA-W-57,802F), who became totally or partially
separated from employment on or after July 29, 2004,
through September 28, 2007, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974.”
I further determine that all workers of Sara Lee
Branded Apparel, Division of the Sara Lee Corporation,
formerly known as National Textiles, LLC, currently
known as Hanesbrands, Inc., Winston-Salem, North
Carolina (TA-W-57,802), and including an employee of
Sara Lee Branded Apparel, Division Office, Division of
Sara Lee Corporation, formerly known as National
Textiles, LLC, currently known as Hanesbrands, Inc.,
Winston Salem, North Carolina, located in Covington,
Georgia (TA-W-57,802F) are denied eligibility to apply
for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974.

Certification Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Negative Determination Regarding Eligibility To Apply For
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated in response to a petition
received on August 19, 2005, and filed on behalf of workers at Sara
Lee Branded Apparel, Division of the Sara Lee Corporation, Winston-
Salem, North Carolina. The workers were engaged in activities
related to the production of underwear (shorts and T-shirts).
The investigation revealed that sales, production and
employment declined at the subject facility during the relevant
period.
The investigation also revealed that aggregate U.S. imports of
underwear (shorts and T-shirts) increased during the relevant
period. The ratio of U.S. imports to U.S. shipments of underwear
was over 800 percent during the twelve month period ending June
2005, reflecting a significant increase over the 2004 period in
which the ratio was slightly over 500 percent.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
The group eligibility criteria for the ATAA program

that the Department must consider under Section 246 of the

Trade Act are:

1. Whether a significant number of workers in the workers'
firm are 50 years of age or older.

2. Whether the workers in the workers' firm possess skills
that are not easily transferable.

3. The competitive conditions within the workers' industry
(i.e., conditions within the industry are adverse).

The Department has determined that criterion 2 has not been
met. The investigation revealed that workers of the subject firm
possess skills that are easily transferable to other positions in
the local area.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with underwear (shorts and T-shirts)
produced at Sara Lee Branded Apparel, Division Office, Winston-
Salem, North Carolina, contributed importantly to the total or
partial separation of workers and to the decline in sales or
production and at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:


"All workers of Sara Lee Branded Apparel, Division of the Sara
Lee Corporation, Winston-Salem, North Carolina, who became
totally or partially separated from employment on or after
July 29, 2004, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974.” and
I further determine that all workers of Sara Lee Branded
Apparel, Division of the Sara Lee Corporation, Winston-Salem,
North Carolina, are denied eligibility to apply for
alternative trade assistance under section 246 of the Trade
Act of 1974.

certification to include an employee of the Division Office,
Winston-Salem, North Carolina facility of the Sara Lee Branded
Apparel located in Houston, Texas.
The intent of the Department’s certification is to include
all workers of Sara Lee Branded Apparel, Division Office,
Winston-Salem, North Carolina who were adversely affected by
increased imports.

issued as follows:
