Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on August 15, 2005, in response
to a petition filed by a state agency representative on behalf of
workers of USR Optonix, Phosphor Division, a subsidiary of
Mitsubishi Chemical America, Hackettstown, New Jersey. The workers
produce phosphors (luminescent pigment).
The investigation revealed that employment at the Phosphor
division declined during the period of January to September 2005,
when compared to the same period in 2004.
The investigation revealed that USR Optonix, Phosphor
Division, a subsidiary of Mitsubishi Chemical America,
Hackettstown, New Jersey, supplies component parts for television
tubes and a loss of business with a manufacturer of television
tubes whose workers were certified eligible to apply for
adjustment assistance contributed importantly to the separation
or threat of separation of workers at USR Optonix, Phosphor
Division, a subsidiary of Mitsubishi Chemical America,
Hackettstown, New Jersey.
Workers of the subject firm were previously certified eligible
to apply for adjustment assistance under petition number TA-W-
52,466. That certification expired on September 12, 2005.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in the case that the
requirements of Section 246 have been met.
A significant number of workers at the facilities are age 50
or over and possess skills that are not easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of USR Optonix, Phosphor
Division, a subsidiary of Mitsubishi Chemical America,
Hackettstown, New Jersey, qualify as adversely affected secondary
workers under Section 222 of the Trade Act of 1974, as amended.
In accordance with the provisions of the Act, I make the
following certification:
“All workers of USR Optonix, Phosphor Division, a subsidiary
of Mitsubishi Chemical America, Hackettstown, New Jersey, who
became totally or partially separated from employment on or
after September 13, 2005, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974;” and
“All workers of USR Optonix, Phosphor Division, a subsidiary
of Mitsubishi Chemical America, Hackettstown, New Jersey, who
became totally or partially separated from employment on or
after August 15, 2004, through two years from the date of
certification, are eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974, as amended."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on August 15, 2005 in response
to a petition filed by a state agency representative on behalf of
workers of USR Optonix, MCI Optonix Division, a subsidiary of
Mitsubishi Chemical America, Cedar Knolls, New Jersey. The workers
produce X-ray intensifying screens.
The MCI Optonix Division employs on-site leased workers from
Express Personnel, Parsippany, New Jersey.
The investigation revealed that production and employment at
the subject facility decreased absolutely in January through
September 2005.
The Department of Labor surveyed the MCI Optonix Division’s
major declining customers regarding their purchases of X-ray
intensifying screens during 2002, 2003, and January through July
2005. The survey revealed increasing imports during the period
under investigation.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with X-ray intensifying screens
produced by USR Optonix, MCI Optonix Division, a subsidiary of
Mitsubishi Chemical America, Cedar Knolls, New Jersey, contributed
importantly to the total or partial separation of workers and to
the decline in sales or production at that firm or subdivision.
In accordance with the provisions of the Act, I make the
following certification:
“All workers of USR Optonix, MCI Optonix Division, a
subsidiary of Mitsubishi Chemical America, Cedar Knolls, New
Jersey, including on-site leased workers from Express
Personnel, who became totally or partially separated from
employment on or after August 1, 2004 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."
