Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) and Section 246 of the Trade Act of 1974 (26 USC 2813),
as amended, the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance (TAA) and
Alternative Trade Adjustment Assistance (ATAA) on July 11, 2005,
applicable to all workers of Leviton Manufacturing Company, Inc.,
Hillsgrove Division, Warwick, Rhode Island. The notice was
published in the Federal Register on August 26, 2005 (FR 70 pp.
50412 and 50415).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
produce residential wiring devices.
The review shows that the Department established the June
27, 2005 impact date for worker group eligibility to apply for
TAA and ATAA based on the June 26, 2005 expiration date of the
previous certification issued for workers of Leviton
Manufacturing Company, Inc., Hillsgrove Division in Warwick,
Rhode Island (TA-W-50,350). Since the worker group was not
previously certified eligible to apply for alternative trade
adjustment assistance, the Department is amending the current
ATAA certification to change the impact date from June 27, 2005
to June 20, 2004.
The amended notice applicable to TA-W-57,436 is hereby
issued as follows:
"All workers of Leviton Manufacturing Company, Inc.,
Hillsgrove Division, Warwick, Rhode Island, who became
totally or partially separated from employment on or after
June 27, 2005 through July 11, 2007, are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974;” and
“All workers of Leviton Manufacturing Company, Inc.,
Hillsgrove Division, Warwick, Rhode Island, who became
totally or partially separated from employment on or after
June 20, 2004, are eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on June 22, 2005, in response
to a petition filed by a company official on behalf of workers of
Leviton Manufacturing Company, Inc., Hillsgrove Division, Warwick,
Rhode Island. The workers produce residential electrical wiring
devices.
The investigation revealed that production and employment
declined from January through April 2005 over the corresponding
2004 period.
The Department of Labor surveyed the subject firm’s major
declining customers regarding their purchases of residential
electrical wiring devices in 2003, 2004 and during January through
April 2005. The survey revealed that customers increased import
purchases of residential wiring devices during relevant period.
The investigation also revealed subject firm was previously
certified (TA-W-50,350). The previous determination was denied on
March 21, 2003 and revised on reconsideration on June 26, 2003.
The current certification expired on June 26, 2005.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with residential electrical wiring
devices produced by Leviton Manufacturing Company, Inc., Hillsgrove
Division, Warwick, Rhode Island contributed importantly to the
total or partial separation of workers and to the decline in sales
or production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:



"All workers of Leviton Manufacturing Company, Inc.,
Hillsgrove Division, Warwick, Rhode Island, who became totally
or partially separated from employment on or after June 27,
2005 through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974 and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
