Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(B) of Section 222 have been met.
The investigation was initiated on April 14, 2005, in
response to a petition filed by the State of Oregon on behalf of
workers at VWR International, Salem, Oregon. The workers of VWR
International stocked and ordered clean room products such as
garments and safety equipment.
The investigation revealed that workers of VWR
International, Salem, Oregon, were contracted to SUMCO Oregon
Corporation, Salem North Division, a subsidiary of SUMCO USA,
Salem, Oregon. The workers of VWR International worked on-site
at the SUMCO USA production facility to stock and order clean
room products for SUMCO's production of silicon wafers.
The investigation revealed that employment of the VWR
International workers declined as a result of SUMCO Oregon
Corporation shifting production of silicon wafers to foreign
locations and the likelihood of increasing imports of like or
directly competitive articles.
Workers of SUMCO Oregon Corporation, Salem North Division,
a subsidiary of SUMCO USA were certified eligible to apply for
trade adjustment assistance under petition number TA-W-55,232,
which expires on August 18, 2006.
The petitioner also requested consideration for alternative
trade adjustment assistance (ATAA). Since the workers of SUMCO
Oregon Corporation, Salem North Division, a subsidiary of SUMCO
USA, Salem, Oregon, are certified eligible to apply for ATAA,
the Department is extending that eligibility to the employees of
VWR International, Salem, Oregon working on-site at SUMCO Oregon
Corporation, Salem North Division, a subsidiary of SUMCO USA,
Salem, Oregon.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from SUMCO Oregon Corporation, Salem North Division, a
subsidiary of SUMCO USA, Salem, Oregon to Japan and Indonesia of
articles that are like or directly competitive with those
produced by SUMCO Oregon Corporation, Salem North Division, a
subsidiary of SUMCO USA, Salem, Oregon, and there has been or is
likely to be an increase in imports of like or directly
competitive articles. In accordance with the provisions of the
Act, I make the following certification:
"Workers employed by VWR International working at SUMCO
Oregon Corporation, Salem North Division, a subsidiary of
SUMCO USA, Salem, Oregon, who became totally or partially
separated from employment on or after March 29, 2004
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974, and are also eligible to
apply for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974."
