Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
on May 6, 2005, applicable to workers of Valspar-Furniture Sales
Group & International Color Design Center, a subsidiary of
Valspar Global Wood Coatings, High Point, North Carolina. The
notice was published in the Federal Register on May 25, 2005 (70
FR 30146).
At the request of the state agency, the Department reviewed
the certification for workers of the subject firm.
New Information shows that Valspar-Furniture Sales Group &
International Color Design Center, a subsidiary of Valspar-Global
Wood Coatings is doing business as Engineered Polymer Solutions.
Information also shows that worker separations have occurred
involving out-stationed employees of the subject firm who
supported production at the High Point, North Carolina location
from the following states: Virginia, Vermont, California and
Michigan.
Based on this new information, the Department is amending
this certification to include “doing business as Engineered
Polymer Solutions” and to also include out-stationed employees of
the subject firm located in the following states: Virginia,
Vermont, California and Michigan.
The intent of the Department’s certification is to include
all workers of Valspar-Furniture Sales Group & International
Color Design Center, a subsidiary of Valspar Global Wood
Coatings, d/b/a Engineered Polymer Solutions, High Point, North
Carolina and out-stationed personnel who was adversely affected
by increased imports.


The amended notice applicable to TA-W-56,863 is hereby
issued as follows:
“All workers of Valspar-Furniture Sales Group &
International Color Design Center, a subsidiary of
Valspar Global Wood Coatings, d/b/a/ Engineered Polymer
Solutions, High Point, North Carolina (TA-W-56,863),
including out-stationed personnel in Virginia (TA-W-
863A), Vermont (TA-W-863B), California (TA-W-863C) and
Michigan (TA-W-863D) who became totally or partially
separated from employment on or after March 14, 2004,
through May 6, 2007, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on March 31, 2005 in response
to a petition filed by a company official on behalf of workers of
Valspar-Furniture Sales Group & International Color Design Center,
a subsidiary of Valspar Global Wood Coatings, High Point, North
Carolina. The workers are engaged in creating color styles and
artistic decorations for furniture, as well as selling and
providing technical assistance related to wood coatings produced at
the nearby affiliated furniture production facility in High Point.
In order to be considered eligible to apply for trade
adjustment assistance under Section 223 of the Trade Act of 1974,
the subject worker group must work for a firm or appropriate
subdivision that produces an article domestically and there must be
a relationship between the workers’ work and the article produced
by the workers’ firm or appropriate subdivision. This
investigation has revealed that reduced demand for the color
styling, sales and technical service work at the subject facility
originated in part at an affiliated facility, Valspar Global Wood
Coatings, High Point, North Carolina, which produces and supplies
furniture coatings to various furniture manufacturers whose workers
have been certified as eligible to apply for adjustment assistance.
The coatings constitute component parts for the production of
furniture, and a loss of business with the furniture manufacturers
contributed importantly to the workers separation or threat of
separation at the subject facility.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in this case that the
requirements of Section 246 have been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Valspar-Furniture Sales
Group & International Color Design Center, a subsidiary of Valspar
Global Wood Coatings, High Point, North Carolina qualify as
adversely affected secondary workers under Section 222 of the Trade
Act of 1974, as amended.
In accordance with the provisions of the Act, I make the
following certification:
“All workers of Valspar-Furniture Sales Group & International
Color Design Center, a subsidiary of Valspar Global Wood
Coatings, High Point, North Carolina who became totally or
partially separated from employment on or after March 14,
2004, through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974."
