Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results
of its investigation regarding certification of eligibility to
apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(A) of Section 222 have been met for TA-W-56,763, TA-W-
56,763A, TA-W,763C, TA-W-56,763D, TA-W-56,763F, TA-W-56,763G,
TA-W-56,763H, TA-W-56,763I, and TA-W-56,763J. Criteria I.A and
II.A have not been met for TA-W-56,763K and TA-W-56,763M. The
investigation of TA-W-56,763B, TA-W-56,763E, and TA-W-56,763L is
being terminated.
The investigation was initiated on March 16, 2005 in
response to a petition filed by a state agency representative on
behalf of workers of Quaker Fabric Corporation of Fall River,
Plant A/B-700, a subsidiary of Quaker Fabric Corporation, Fall
River, Massachusetts (TA-W-56,763), Quaker Fabric Corporation of
Fall River, Plant C-710, a subsidiary of Quaker Fabric
Corporation, Fall River, Massachusetts (TA-W-56,763A), Quaker
Fabric Corporation of Fall River, Plant C-710, Design Group, A
subsidiary of Quaker Fabric Corporation, Fall River,
Massachusetts (TA-W-56,763B), Quaker Fabric Corporation of Fall
River, Plant D-730, A subsidiary of Quaker Fabric Corporation,
Fall River, Massachusetts (TA-W-56,763C), Quaker Fabric
Corporation of Fall River, Plant E-735, A subsidiary of Quaker
Fabric Corporation, Fall River, Massachusetts (TA-W-56,763D),
Quaker Fabric Corporation of Fall River, Plant H-739, A

Fall River, Massachusetts (TA-W-56,763M). These 13 facilities
are vertically integrated they collective produce upholstery
fabric and specialty yarns.
The workers of the design group of Plant C (TA-W-56,763B)
are covered by an active certification that was issued on
January 21, 2005 (TA-W-56,057), which remains in effect until
January 21, 2007. Consequently, further investigation of this
facility would serve no purpose and the investigation of this
facility has been terminated.
The investigation revealed that employment at plants A/B-
700 (TA-W-56,763), C-710 (TA-W-56,763A), D-730 (TA-W-56,763C),
E-735 (TA-W-56,763D), I-739 (TA-W-56,763F), J-720 (TA-W-
56,763G), K-736 (TA-W-56,763H), L-734 (TA-W-56,763I), and M-721
(TA-W-56,763J) decreased in the past year. Employment at plants
N-722 (TA-W-56,763K) and Q-733 (TA-W-56,63M) increased in the
past year. Plants H-739 (TA-W-56,763E) and P-723 (TA-W-56,763L)
are warehouse facilities that did not employ any workers during
the relevant period. The investigation of these two facilities
has been terminated. In order to establish a valid worker group
there must be at least three full-time workers employed at some
point during the period under investigation.
The investigation revealed that the subject firm's sales
and production decreased in terms of quantity in 2004 compared
to 2003 and during the period of January through February of
2005 compared to the same period in 2004.
The investigation further revealed that subject firm did
not import upholstery fabrics or specialty yarns in 2003, 2004
or January through February of 2005, nor did it shift production
to a foreign country.
The Department of Labor surveyed the subject facility's
major customers regarding their purchasing of upholstery fabric
during the period under investigation. This survey revealed
increased imports.
In accordance with Section 246 the Trade Act of 1974 (26
USC 2813), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility
requirements of Section 246 of the Trade Act must be met. The
Department has determined in this case that the requirements of
Section 246 have been met.
A significant number of workers at the firm are age 50 or
over and possess skills that are not easily transferable.
Competitive conditions within the industry are adverse.
Furthermore the investigation revealed that criteria I.A
and II.A have not been met for Plant N-722 (TA-W-56,763K) and
Plant Q-733 (TA-W-56,763M). Employment increased at both of
these facilities in the past year.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the worker group must be
certified eligible to apply for trade adjustment assistance
(TAA). Since the workers are denied eligibility to apply for
TAA, the workers cannot be certified eligible for ATAA.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with upholstery fabric produced at
Quaker Fabric Corporation of Fall River's operations in Fall
River, Massachusetts; Somerset, Massachusetts; and Brockton,
Massachusetts contributed importantly to the total or partial
separation of workers and to the decline in sales or production
and at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Quaker Fabric Corporation of Fall River,
Plant A/B-700, a subsidiary of Quaker Fabric Corporation,
Fall River, Massachusetts (TA-W-56,763), Quaker Fabric
Corporation of Fall River, Plant C-710, a subsidiary of
Quaker Fabric Corporation, Fall River, Massachusetts (TA-W-
56,763A), Quaker Fabric Corporation of Fall River, Plant D-
730, A subsidiary of Quaker Fabric Corporation, Fall River,
Massachusetts (TA-W-56,763C), Quaker Fabric Corporation of
Fall River, Plant E-735, A subsidiary of Quaker Fabric
Corporation, Fall River, Massachusetts (TA-W-56,763D)
Quaker Fabric Corporation of Fall River, Plant I-739, A
subsidiary of Quaker Fabric Corporation, Somerset,
Massachusetts (TA-W-56,763F), Quaker Fabric Corporation of

eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974, and are also eligible to
apply for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974."
I further determine that all workers of Quaker Fabric
Corporation of Fall River, Plant N-722, a subsidiary of Quaker
Fabric Corporation, Fall River Massachusetts (TA-W-56,763K) and
Quaker Fabric Corporation of Fall River, Plant Q-733, a
subsidiary of Quaker Fabric Corporation, Fall River
Massachusetts (TA-W-56,763M) are denied eligibility to apply for
adjustment assistance under Section 223 of the Trade Act of 1974
and alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.
