Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met for workers of American Pad and Paper,
LLC (AMPAD), Holyoke, Massachusetts (TA-W-56,724); American Pad and
Paper, LLC (AMPAD), AMPAD Distribution Center, Westfield,
Massachusetts (TA-W-56,724A); American Pad and Paper, LLC (AMPAD),
AMPAD Distribution Center, Mattoon, Illinois (TA-W-56,724B); and
American Pad and Paper, LLC (AMPAD), Morristown, Tennessee (TA-W-
56,724C).
The investigation was initiated on February 10, 2005 in
response to a petition filed by a company official on behalf of
workers at American Pad and Paper, LLC (AMPAD), Holyoke,
Massachusetts; American Pad and Paper, LLC (AMPAD), AMPAD
Distribution Center, Westfield, Massachusetts; American Pad and
Paper, LLC (AMPAD), AMPAD Distribution Center, Mattoon, Illinois;
American Pad and Paper, LLC (AMPAD), Morristown, Tennessee; and
American Pad and Paper, LLC (AMPAD), West Valley, Utah. Workers at
the facilities in Holyoke, Massachusetts, and West Valley City,
Utah produce paper based office supply products including writing
pads, filing products, and envelopes. Workers at the facility in
Morristown, Tennessee produce envelopes. The remaining two
facilities served as distribution centers.
All employees at AMPAD are co-employed by Administaff under a
professional employment organization (PEO).
The preponderance in the declines, and anticipated declines,
in employment at the facilities in Holyoke, Massachusetts;
Westfield, Massachusetts; Mattoon, Illinois; and Morristown,
Tennessee is related to a shift in production of paper office
products to a country (Mexico) that is a party to a free trade
agreement with the United States.
In addition, In order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined that in the case of these four
facilities the requirements of Section 246 have been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
The workers of American Pad and Paper, LLC (AMPAD), West
Valley, Utah (TA-W-56,724D) are covered by an active certification
that was issued on June 16, 2004 (TA-W-54,634), which remains in
effect until June 16, 2006. Consequently, further investigation of
this facility would serve no purpose and the investigation of this
facility has been terminated.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers' firm or subdivision to Mexico of articles that
are like or directly competitive with those produced by the subject
firm or subdivision. In accordance with the provisions of the Act,
I make the following certification:


"All workers of American Pad and Paper, LLC (AMPAD), Holyoke,
Massachusetts (TA-W-56,724); American Pad and Paper, LLC
(AMPAD), AMPAD Distribution Center, Westfield, Massachusetts
(TA-W-56,724A); American Pad and Paper, LLC (AMPAD), AMPAD
Distribution Center, Mattoon, Illinois (TA-W-56,724B); an
American Pad and Paper, LLC (AMPAD), Morristown, Tennessee
(TA-W-56,724C) who became totally or partially separated from
employment on or after March 8, 2004 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."
Furthermore, I determine that the investigation of workers of
American Pad and Paper, LLC (AMPAD), West Valley, Utah (TA-W-
56,724D) has been terminated for the aforementioned reasons.
