Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on March 10, 2005 in response
to a petition filed on behalf of workers of IH Apparel Group, LLC,
formerly known as Isaac Hazan and Company, Inc., New York, New
York. The workers of the subject firm produce women's blazers,
skirts, and pants.
The investigation revealed that sales, production, and
employment at the subject firm decreased from 2003 to 2004 and
during the period of January through February 2005, when compared
to the same period in 2004.
Aggregate imports of women's and girls' coats and jackets also
were at a high level, over 809 percent of U.S. shipments in 2002,
and increased absolutely in 2003. Imports of women's and girls'
coats and jackets continued to increase absolutely during the
second quarter of 2004, when compared to the first quarter of 2004.
Aggregate United States imports of women's and girls' skirts
increased absolutely in 2003 compared with 2002, and increased
relative to U.S. shipments, from under 350 percent to over 500
percent from 2002 to 2003. Imports of women's and girls' skirts
continued to increase during the second quarter of 2004, when
compared to the first quarter of 2004.
Aggregate United States imports of women's and girls' bottoms
(except skirts) increased absolutely in 2003 compared with 2002,
and increased relative to U.S. shipments, from under 380 percent to
over 570 percent from 2002 to 2003. The import to shipment ratio
of women's and girls' bottoms continued to increase during the
second quarter of 2004, when compared to the first quarter of 2004.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with women's blazers, skirts, and
pants produced at IH Apparel Group, LLC, New York, New York
contributed importantly to the total or partial separation of
workers and to the decline in sales or production and at that firm
or subdivision. In accordance with the provisions of the Act, I
make the following certification:
"All workers of the IH Apparel Group, LLC, formerly known as
Isaac Hazan and Company, Inc., New York, New York, who became
totally or partially separated from employment on or after
February 23, 2004 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
