Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Negative Determination Regarding Eligibility to Apply for
Alternative Trade Adjustment Assistance on February 22, 2005,
applicable to workers of Pfaltzgraff Company, Pfaltzgraff
Distribution Center, including on-site leased workers from
Manpower, Inc. and Adecco, York, Pennsylvania. The notice was
published in the Federal Register on March 9, 2005 (70 FR 11704).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
provide packing and shipping services in direct support of the
production of ceramic dinnerware produced at the Thomasville,
Pennsylvania (TA-W-56,418) location of the subject firm.
New findings show that there was a previous certification,
TA-W-41,917, issued on September 30, 2002, for workers of
Pfaltzgraff Company, York, Pennsylvania who were engaged in
employment related to the production of ceramic dinnerware. That
certification expired September 30, 2004. To avoid an overlap in
worker group coverage, the certification is being amended to
change the impact date from January 27, 2004 to October 1, 2004,
for workers of the subject firm.
The amended notice applicable to TA-W-56,418 is hereby
issued as follows:
"All workers of Pfaltzgraff Company, Pfaltzgraff
Distribution Center, including on-site leased workers from
Manpower, Inc., and Adecco, York Pennsylvania (TA-W-
56,418A), who became totally or partially separated from
employment on or after October 1, 2004, through February 22,
2007, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also eligible
to apply for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974.”

Certifications Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273), as amended, the
Department of Labor herein presents the results of its investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply
for Trade Adjustment Assistance, the group eligibility requirements in either paragraph (a)(2)(A) or
(a)(2)(B) of Section 222 of the Trade Act must be met. It is determined in this case that the
requirements of (a)(2)(A) of Section 222 have been met.
The investigation was initiated on January 28, 2005 in response to a petition filed by a
company official on behalf of workers of Pfaltzgraff Company, Thomasville, Pennsylvania (TA-W-
56,418) and Pfaltzgraff Company, Pfaltzgraff Distribution Center, York, Pennsylvania (TA-W-
56,418A).
The investigation revealed that sales, production and employment at the Thomasville facility
(TA-W-56,418) decreased absolutely during the period of January to November 2004, when
compared to the same period in 2003.
The investigation also revealed that the Thomasville facility (TA-W-56,418) leased some
workers from Manpower, Inc., York, Pennsylvania; Contemporary Personnel, York, Pennsylvania;
and Adecco, York Pennsylvania during the relevant period.
Furthermore, imports of ceramic dinnerware by the Pfaltzgraff Company increased during the
relevant period.
Workers of the York facility (TA-W-56,418A) provide packing and shipping services in
direct support of the Thomasville facility. The investigation revealed that the York facility
experienced a decline in employment during the relevant period.
The investigation also revealed that the York, Pennsylvania facility (TA-W-56,418A) leased
some workers from Manpower, York, Pennsylvania; and Adecco, York, Pennsylvania during the
relevant period.
In accordance with Section 246 the Trade Act of 1974 (26 USC 2813), as amended, the
Department of Labor herein presents the results of its investigation regarding certification of
eligibility to apply for alternative trade adjustment assistance (ATAA) for older workers.


In order for the Department to issue a certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have been met for workers of Pfaltzgraff
Company, Thomasville, Pennsylvania (TA-W-56,418) and Pfaltzgraff Company, Pfaltzgraff
Distribution Center, York, Pennsylvania (TA-W-56,418A).
A significant number of workers at the firm are age 50 or over and possess skills that are not
easily transferable. Competitive conditions within the industry are adverse.
















Conclusion
After careful review of the facts obtained in the investigation, I determine that increases of
imports of articles like or directly competitive with the ceramic dinnerware produced at Pfaltzgraff
Company, Thomasville, Pennsylvania (TA-W-56,418) contributed importantly to the total or partial
separation of workers and to the decline in sales or production at that firm or subdivision. In
accordance with the provisions of the Act, I make the following certifications:
"All workers of Pfaltzgraff Company, including on-site leased workers from Manpower, Inc.,
Contemporary Personnel, and Adecco, Thomasville, Pennsylvania (TA-W-56,418) and
Pfaltzgraff Company, Pfaltzgraff Distribution Center, including on-site leased workers from
Manpower, Inc., and Adecco, York, Pennsylvania (TA-W-56,418A), who became totally or
partially separated from employment on or after January 27, 2004, through two years from
the date of certification are eligible to apply for adjustment assistance under Section 223 of
the Trade Act of 1974, and are also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”
