Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on
December 14, 2004, applicable to workers of Ag World Support
Systems, LLC, a subsidiary of Ag World Group, on-site at J. R.
Simplot Company, Hermiston, Oregon. This notice will be
published soon in the Federal Register.
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are on-site inspectors in support of the production of potato
products.
Information shows that the Oregon Employment Department
requested Alternative Trade Adjustment Assistance (ATAA) on
behalf of the workers of the subject firm, but that request was
not addressed in the decision document.
Information obtained from the company states that a
significant number of workers of the subject firm are age 50 or

over, workers have skills that are not easily transferable, and
conditions in the industry are adverse. Review of this
information shows that all eligibility criteria under Section
246 of the Trade Act of 1974 (26 USC 2813), as amended, have
been met.
Accordingly, the Department is amending the certification
to reflect its finding.
The amended notice applicable to TA-W-55,921 is hereby
issued as follows:
"Workers employed by Ag World Support Systems, LLC, a
subsidiary of Ag World Group, Hermiston, Oregon, working at
J.R. Simplot Company, Hermiston, Oregon, who became totally
or partially separated from employment on or after November
2, 2003, through December 14, 2006 are eligible to apply
for adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for alternative
trade adjustment assistance under Section 246 of the Trade
Act of 1974.”

Certification Regarding Eligibility
To Apply For Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results
of its investigation regarding certification of eligibility to
apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(B) of Section 222 have been met.
The investigation was initiated on November 4, 2004 in
response to a petition filed by a company representative on
behalf of the workers of Ag World Support Systems, LLC, employed
at J.R. Simplot Company, Hermiston, Oregon. The workers are on-
site inspectors in support of the production of potato products.

The investigation revealed that the workers of Ag World
Support Systems, LLC, Hermiston, Oregon were contracted to J.R.
Simplot Company, Hermiston, Oregon during 2003 and 2004.
The investigation further revealed that the workers of J.R.
Simplot Company, Hermiston, Oregon are certified eligible to
apply for trade adjustment assistance under petition TA-W-
54,940, based on a shift in production to a country (Canada)
with a free trade agreement.
The investigation also revealed that the employment of the
Ag World Support Systems contracted workers located at the J.R.
Simplot Company, Hermiston, Oregon declined as a result of the
shift in production of potato products to Canada.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
of potato products to Canada that are like or directly
competitive with those produced by J.R. Simplot Company,
Hermiston, Oregon. In accordance with the provisions of the
Act, I make the following certification:







"Workers employed by Ag World Support Systems, LLC, a
subsidiary of Ag World Group, Hermiston, Oregon, working at
J.R. Simplot Company, Hermiston, Oregon, who became totally
or partially separated from employment on or after November
2, 2003, through two years from the date of certification
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.”
