Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued Amended Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance on September 20,
2004, applicable to workers of Galey & Lord Industries, Inc., New
York, New York and Galey & Lord Industries, Inc., Greensboro
Corporate Office, Greensboro, North Carolina. The notice was
published in the Federal Register on October 4, 2004
(69 FR 62463).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers are engaged in the production of cotton fabric.
New information shows that Galey & Lord Industries, Inc.,
New York, New York is now known as Galey & Lord Industries, LLC,
New York Office, New York, New York and Galey & Lord Industries,
Inc., is now known as Galey & Lord Industries, LLC, Greensboro
Textile Administration LLC, Greensboro Office, Greensboro, North
Carolina. Workers separated from employment at the subject firm
had their wages reported under two separate unemployment
insurance (UI) tax accounts for Galey & Lord Industries, LLC, New
York Office, New York, New York and Galey & Lord Industries, LLC,
Greensboro Textile Administration LLC, Greensboro Office,
Greensboro, North Carolina.
Accordingly, the Department is amending this certification
to properly reflect this matter.
The intent of the Department’s certification is to include
all workers of Galey & Lord Industries, Inc., now known as Galey
& Lord Industries, LLC, New York Office, New York, New York and
Galey & Lord Industries, Inc., now known as Galey & Lord
Industries, LLC, Greensboro Textile Administration LLC,
Greensboro Office, Greensboro, North Carolina who were adversely
affected by increased imports.



The amended notice applicable to TA-W-55,520 and TA-W-
55,520A are hereby issued as follows:
"All workers of Galey & Lords Industries, Inc., now known as
Galey & Lords Industries, LLC, New York Office, New York,
New York (TA-W-55,520) and Galey & Lord Industries, Inc.,
now known as Galey & Lord Industries, LLC, Greensboro
Textile Administration LLC, Greensboro Office, Greensboro,
North Carolina (TA-W-55,520A) who became totally or
partially separated from employment on or after August 24,
2003, through September 20, 2006, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”

Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on in response to a petition
received on August 31, 2004 in response to a petition filed by a
company official on behalf of workers at Galey & Lord Industries,
Inc., New York, New York (TA-W-55,520) and Galey & Lord Industries,
Greensboro Corporate Office, Greensboro, North Carolina (TA-W-
55,520A). The workers were engaged in employment related to the
production of cotton fabric.
The investigation revealed that employment at the subject firm
declined during the relevant period.
The investigation determined that worker separations at Galey
& Lord Industries, Inc., New York, New York and Greensboro
Corporate Office in Greensboro, North Carolina, are attributable to
a loss of business with numerous manufacturers (whose workers were
certified eligible to apply for adjustment assistance). This loss
of business contributed importantly to the workers separation or
threat of separation.
The petitioner also requested consideration for Alternative
Trade Adjustment Assistance (ATAA).
In order to issue a certification of eligibility to apply for
ATAA for older workers, the group eligibility requirements of
Section 246(a)(3)(A)(ii) of the Trade Act must be met. The
Department has determined in this case that the requirements have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.



Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Galey & Lord Industries,
Inc., New York, New York (TA-W-55,520) and Galey & Lord Industries,
Greensboro Corporate Office, Greensboro, North Carolina (TA-W-
55,520A) qualify as adversely affected secondary workers under
Section 222 of the Trade Act of 1974, as amended. In accordance
with the provisions of the Act, I make the following certification:
"All workers of Galey & Lord Industries, Inc., New York, New
York (TA-W-55,520) and Galey & Lord Industries, Greensboro
Corporate Office, Greensboro, North Carolina (TA-W-55,520A),
who became totally or partially separated from employment on
or after August 24, 2003, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974."
