Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974, (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on May 20, 2004,
applicable to workers of the WestPoint Stevens, Inc., Drakes
Branch, Virginia. The notice was published in the Federal
Register on June 17, 2004 (69 FR 33942).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers are engaged in the production of bath towels.
Information submitted to the Department shows that on August
8, 2005, American Real Estate Partners purchased WestPoint
Stevens, Inc. and is now known as WestPoint Home, Inc.
Accordingly, the Department is amending this certification
to reflect the new ownership.


The intent of the Department’s certification is to include
all workers of WestPoint Stevens, Inc. who were adversely
affected by increased imports.
The amended notice applicable to TA-W-54,883 is hereby issued
as follows:
"All workers of WestPoint Stevens, Inc., Now Known as
WestPoint Home, Inc., Drakes Branch, Virginia, who became
totally or partially separated from employment on or after
April 28, 2003, through May 20, 2006, are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974, and are also eligible to apply for alternative
trade adjustment assistance under Section 246 of the Trade
Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on May 11, 2004 and filed by a
company official on behalf of workers at WestPoint Stevens, Inc.,
Drakes Branch, Virginia. The workers produce bath towels.
The investigation revealed that employment, sales, and
production declined at the subject firm from 2002 to 2003.
Additional separations are anticipated beginning in May 2004.
The investigation also revealed that company imports of bath
towels increased both in 2003 and in January through April, 2004
compared to the same period in the previous year.

Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive produced at the subject firm
contributed importantly to the total or partial separation of
workers and to the decline in sales and production at that firm.
In accordance with the provisions of the Act, I make the following
certification:
“All workers of WestPoint Stevens, Inc., Drakes Branch,
Virginia, who became totally or partially separated from
employment on or after April 28, 2003 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”
