Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results
of its investigation regarding certification of eligibility to
apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a) (2) (A) of Section 222 have been met.
The investigation was initiated on May 10, 2004 in response
to a petition filed by a company official on behalf of workers
of J&L Specialty Steel, LLC, Corporate Headquarters, Moon
Township, Pennsylvania (TA-W-54,870); and J&L Specialty Steel,
LLC, Midland Plant, Midland, Pennsylvania (TA-W-54,870A). The
workers at the corporate headquarters of the subject firm are
engaged in employment activities related to the production of
hot-rolled and cold-rolled stainless steel at the Midland,
Pennsylvania Plant.
The investigation revealed that leased workers from
Intelligent Personnel Services, Information Technology
Professionals Inc., Technical Solutions Incorporated, Reflex
Staffing Solutions Inc., Ohio Security Services Incorporated,
US Security, Allied Security, and Accounttemps working at the
subject facilities described above are a portion of the affected
worker group.
The investigation revealed that sales, production, and
employment declined absolutely during the period of January


through April 2004 when compared to the same time period in
2003.
The Department of Labor surveyed the subject facilities's
major declining customers regarding their purchases of hot-
rolled and cold-rolled stainless steel. This survey revealed
increases in imports of hot-rolled and cold-rolled stainless
steel during the period under investigation.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility
requirements of Section 246 of the Trade Act must be met. The
Department has determined in this case that the requirements of
Section 246 have been met.
A significant number of workers at the J&L Specialty Steel
LLC, Moon Township, Pennsylvania facility and at the J&L
Specialty Steel LLC, Midland, Pennsylvania facility are age 50
or over and possess skills that are not easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with hot-rolled and cold-rolled
stainless steel produced by J&L Specialty Steel, LLC,
contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that
facility or subdivision. In accordance with the provisions of
the Act, I make the following certification:
"All workers of J&L Specialty Steel, LLC, Corporate
Headquarters, including leased workers of Intelligent
Personnel Service, Information Technology Professionals
Inc., Technical Solutions Incorporated, Balounis, Deloitte
& Touche, and Reflex Staffing Solutions Inc., Moon
Township, Pennsylvania (TA-W-54,870); and J&L Specialty
Steel, LLC, Midland Plant, including leased workers of Ohio
Security Services Incorporated, US Security, Allied
Security, Technical Solutions, Technical Solutions
Incorporated, and Accounttemps, Midland, Pennsylvania
(TA-W-54,870A), who became totally or partially separated
from employment on or after May 7, 2003, through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under section 246 of the Trade act of
1974."

Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as
amended, an investigation was initiated on May 10, 2004 in
response to a petition filed by a company official on behalf of
workers of J&L Specialty Steel, LLC, Louisville Plant,
Louisville, Ohio.
The petitioning group of workers is covered by an active
certification issued on September 9, 2002 which remains in effect
until September 9, 2004 (TA-W-39,575). Consequently, further
investigation in this case would serve no purpose, and the
investigation has been terminated.
