Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor issued a
Certification of Eligibility to Apply for Worker Adjustment
Assistance on June 23, 2004, applicable to workers of Technical
Associates employed at Brown & Williamson Tobacco Corporation,
Macon Georgia. The notice will be published soon in the Federal
Register.
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The subject
firm workers were leased workers providing research and
development, and training support services at the Macon, Georgia
facility of Brown & Williamson Tobacco Corporation which produces
cigarettes.
New information provided by the company shows that Brown &
Williamson Tobacco Corporation is currently known as R.J. Reynolds
Tobacco Company, an operating subsidiary of Reynolds American, Inc.
as of July 30, 2004. Information also shows that workers separated
from employment at the subject firm had their wages reported under
a separate unemployment insurance (UI) tax account for R.J.
Reynolds Tobacco Company.
Accordingly, the Department is amending the certification to
properly reflect this matter.
The intent of the Department’s certification is to include all
workers of Technical Associates who were leased at Brown &
Williamson Tobacco Corporation, Macon, Georgia, were adversely
affected by increased imports.
The amended notice applicable to TA-W-54,758 is hereby issued
as follows:
“Workers employed by Technical Associates, working at Brown &
Williamson Tobacco Corporation, currently known as R.J.
Reynolds Tobacco Company, an operating subsidiary of Reynolds
American, Inc., Macon, Georgia, who became totally or
partially separated from employment on or after March 18,
2003, through June 23, 2006, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on April 21, 2004 in response
to a petition filed by a company official on behalf of workers of
Technical Associates, leased to Brown & Williamson Tobacco
Corporation, Macon, Georgia. The workers at the subject firm
provide training and research and development support services to
Brown & Williamson Tobacco Corporation.
The investigation revealed that employment of Technical
Associates workers leased to Brown & Williamson in Macon, Georgia
declined from 2002 to 2003, and during the period of January
through March 2004.
The investigation revealed that sales and production of
cigarettes manufactured by Brown & Williamson, Macon, Georgia,
declined from 2002 to 2003, and during the period of January
through March 2004 compared to the same time period of the previous
year.
The Department of Labor surveyed Brown & Williamson Tobacco’s
major declining customers regarding their purchases of cigarettes.
These surveys revealed that customers increased reliance on import
purchases of cigarettes during the period of investigation.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with cigarettes produced by Brown &
Williamson, Macon, Georgia, contributed importantly to the total or
partial separation of workers and to the decline in sales or
production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"Workers employed by Technical Associates, working at Brown &
Williamson Tobacco Corporation, Macon, Georgia, who became
totally or partially separated from employment on or after
March 18, 2003, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
