Negative Determination Regarding Eligibility
To Apply For Worker Adjustment Assistance

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated on April 1, 2004, in response to a
petition filed by the company on behalf of workers of Flynt
Fabrics, Inc., Burlington, North Carolina.
The petition regarding the investigation has been deemed
invalid. In order to establish a valid worker group, there must be
at least three full-time workers employed at some point during the
period under investigation. Workers of the group subject to this
investigation did not meet this threshold level of employment.
The petitioner stated that all production at the subject firm
ceased on May 9, 2003 with some employees retained to liquidate
assets. These remaining employees were laid off on June 30, 2003.
The employees were under an existing Trade Adjustment Assistance
certification (TA-W-39,395B) that expired on August 8, 2003.

Since all workers were under an existing certification at the
time of the final layoff at Flynt Fabrics, Inc., Burlington, North
Carolina, this investigation has been terminated.

Signed in Washington, D. C. this 5th day of May, 2004.
