Certification Regarding Eligibility
To Apply for Trade Adjustment Assistance
And Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on March 25, 2004 in response
to a petition filed by a company official on behalf of workers at
William M. Best Consulting Services, working at Gates Corporation,
Denver, Colorado. The subject firm provides training to
manufacturing personnel.
The investigation revealed that workers of William M. Best
Consulting Services were contracted on-site to Gates Corporation
from 2001-2004 to provide training to manufacturing personnel.
Workers of Gates Corporation, Air Springs Division, Denver,
Colorado, were certified eligible to apply for trade adjustment
assistance and alternative trade adjustment assistance under
petition number TA-W-53,647, which expires on December 15, 2005.
The investigation revealed that employment of the workers of
William M. Best Consulting Services declined as a result of the
shift of production work at Gates Corporation, Denver, Colorado to
Mexico.
The petitioner also requested consideration for alternative
trade adjustment assistance (ATAA). Since the workers of Gates
Corporation, Air Springs Division in Denver, Colorado, are
certified eligible to apply for ATAA, the Department is extending
that eligibility to the employees of William M. Best Consulting
Services working at Gates Corporation, Air Springs Division.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that a shift of production to Mexico of
the shock absorbers produced by Gates Corporation, Air Springs
Division, Denver, Colorado, contributed importantly to the total or
partial separation of workers of William M. Best Consulting
Services. In accordance with the provisions of the Act, I make the
following certification:



"Workers employed by William M. Best Consulting Services
working at Gates Corporation, Denver, Colorado, who became
totally or partially separated from employment on or after
March 24, 2003 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974."
