Negative Determination Regarding Eligibility
To Apply For Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
The investigation was initiated on March 18, 2004 in response
to a petition filed by a company official on behalf of workers of
Volt Services Group, employed at Hewlett Packard Company, Atlanta,
Georgia. The workers provided "helpdesk" technical support
information technology services related to computer applications.
The investigation revealed that the information technology
workers described above are composed of employees of Volt Services
Company and were leased, pursuant to a contract, to work at Hewlett
Packard Company, Atlanta, Georgia. Neither Volt Services Group nor
Hewlett Packard Company produces an article at Atlanta, Georgia.
In addition, work of the employees of Volt Services Group is not
related to the production of an article by Hewlett Packard Company
at another location.
In order to be considered eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, as a
threshold matter, the firm or the worker group seeking
certification (or on whose behalf certification is being sought)
must produce an article. Leased workers under a contractual
relationship with a firm or appropriate subdivision that produces
an article are also treated as workers of a firm producing an
article if their work is related to that production.
Since Volt Services workers do not produce an article and
Hewlett Packard Company does not produce an article with which the
information technology workers are related, this worker group
cannot be found to be employed by an import impacted firm or a firm
affected by a shift in production of an article.
Conclusion
After careful review, I determine that all workers of Volt
Services Group leased, pursuant to a contract, to work at Hewlett
Packard Company, Atlanta, Georgia, are denied eligibility to apply
for adjustment assistance under Section 223 of the Trade Act of
1974, as amended.
