Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
And Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on March 15, 2004,
applicable to workers of Coats American, Inc., Corporate
Headquarters, Charlotte, North Carolina. The notice will be
published soon in the Federal Register.
At the request of a company official, the Department
reviewed the certification for workers of the subject firm.


New information shows that worker separations have
occurred involving employees of the Charlotte, North Carolina
facility of Coats American, Inc., Corporate Headquarters
operating at various locations in the states of Texas, California
and Pennsylvania. These employees provide sales and marketing
support function services for the production of specialty thread
and cocoon bobbins produced by the subject firm.
Based on these findings, the Department is amending this
certification to include sales and marketing employees of the
Coats American, Inc., Corporate Headquarters, Charlotte, North
Carolina, operating at various locations in the states of Texas,
California and Pennsylvania.
The intent of the Department’s certification is to include
all workers of Coats American, Inc. who were adversely affected
by a shift in production to Mexico.



The amended notice applicable to TA-W-54,203B is hereby
issued as follows:
"All workers of Coats American, Inc., Corporate
Headquarters, Charlotte, North Carolina (TA-W-54,203B),
including sales and marketing employees of Coats
American, Inc., Corporate Headquarters, Charlotte,
North Carolina, Regional Manager Southwest, operating
at various locations in the states of Texas (TA-W-
54,203C), California (TA-W-54,203D), and Regional
Manager Northeast, Pennsylvania (TA-W-54,203E), who
became totally or partially separated from employment
on or after February 3, 2003, through March 15, 2006,
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply
for Trade Adjustment Assistance, the group eligibility requirements in either paragraph (a)(2)(A) or
(a)(2)(B) of Section 222 of the Trade Act must be met. It is determined in this case that the
requirements of (a)(2)(B) of Section 222 have been met.
The investigation was initiated on February 9, 2004 in
response to a petition filed by a company official on behalf of
workers at Coats American, Inc., Watertown, Connecticut (TA-W-
54,203); Coats American, Inc., Bronx, New York (TA-W-54,203A), and
Coats American, Inc., Corporate Headquarters, Charlotte, North
Carolina (TA-W-54,203B). Workers at subject facility TA-W-54,203
produce specialty thread. Workers at subject facility TA-W-54,203A
produce cocoon bobbins. Workers at subject facility TA-W-54,203B
are engaged in administrative support of the other two facilities.
The investigation revealed that employment at the subject facilities declined from 2002 to
2003.
Furthermore, the investigation revealed that facilities TA-W-54,203 and TA-W-54,203A
shifted some of the production of specialty thread and cocoon bobbins from Watertown, Connecticut
and Bronx, New York to a country (Mexico) that is a party to a free trade agreement with the United
States.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in this case that the
requirements of Section 246 have been met.
A significant number of workers at the facility are age 50 or
over and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production to
Mexico of articles like or directly competitive with specialty
thread and cocoon bobbins produced by Coats American, Inc.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Coats American, Inc., Watertown, Connecticut
(TA-W-54,203), Coats American, Inc., Bronx, New York (TA-W-
54,203A), and Coats American, Inc., Corporate Headquarters,
Charlotte, North Carolina (TA-W-54,203B), who became totally
or partially separated from employment on or after February 3,
2003 through two years from the date of certification, are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
