Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on February 23, 2004,
applicable to workers of KEMET Electronics Corporation,
Simpsonville Facility, Simpsonville, South Carolina. The notice
was published in the Federal Register on April 6, 2004 (69 FR
18111).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm.
Workers of KEMET’s headquarters are included in the certification
for workers at the Simpsonville Facility located in Simpsonville,
South Carolina. New information provided by the firm shows that
Mr. Larry Budreau and Mr. Jimmy Arflin were separated from
employment with the firm. They were reporting to headquarters
but were working out of Greenwood, South Carolina. They provided
support services related to the electronic capacitors produced by
the firm.
Based on these findings, the Department is amending this
certification to include employees of KEMET Electronics
Corporation, Simpsonville Facility, Simpsonville, South Carolina
working in Greenwood, South Carolina. Since the workers of the
Simpsonville Facility were certified eligible to apply for
alternative trade adjustment assistance, the Department is
extending this eligibility to Mr. Larry Budreau and Mr. Jimmy
Arflin.
The intent of the Department’s certification is to include
all workers of KEMET Electronics Corporation, Simpsonville
Facility, Simpsonville, South Carolina, who were adversely
affected by a shift in production to Mexico.



The amended notice applicable to TA-W-54,129A is hereby
issued as follows:
"All workers of KEMET Electronics Corporation,
Simpsonville Facility, Simpsonville, South Carolina
(TA-W-54,129A), including employees of KEMET
Electronics Corporation, Simpsonville facility,
Simpsonville, South Carolina, located in Greenwood,
South Carolina (TA-W-54,129D), who became totally or
partially separated from employment on or after January
3, 2004, through February 23, 2006, are eligible to
apply for adjustment assistance under Section 223 of
the Trade Act of 1974, and are also eligible to apply
for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on February 2, 2004 in
response to a petition filed by a company official on behalf of
workers at KEMET Electronics Corporation, Mauldin plant,
Simpsonville, South Carolina (TA-W-54,129); KEMET Electronics
Corporation, Simpsonville facility, Simpsonville, South Carolina
(TA-W-54,129A); KEMET Electronics Corporation, Fountain Inn plant,
Fountain Inn, Couth Carolina; and KEMET Electronics Corporation,
Shelby Plant, Shelby, North Carolina (TA-W-54,129C). Workers at
KEMET Electronics Corporation, Mauldin plant, Simpsonville, South
Carolina (TA-W-54,129) and KEMET Electronics Corporation,
Simpsonville facility, Simpsonville, South Carolina (TA-54,129A
are engaged in the production of electronic capacitors made out of
Tantalum. KEMET Electronics Corporation’s headquarters is also
located at the Simpsonville facility. These workers support the
production workers at the same site as well as production workers
at the three other facilities. Workers at KEMET Electronics
Corporation, Fountain Inn plant, Fountain Inn, South Carolina (TA-
W-54,129B are engaged in the production of electronic capacitors
made out of ceramic material. Workers at KEMET Electronics
Corporation, Shelby plant, Shelby, North Carolina (TA-W-54,129C)
are engaged in the production of ceramic sheet that is used to
produce electronic capacitors.
The investigation revealed that KEMET Electronics Corporation,
Shelby plant, Shelby, North Carolina, also leases workers from
Personnel Services Unlimited.
Workers of KEMET Electronics Corporation engaged in employment
related to the production of ceramic and tantalum capacitors at the
Mauldin, Simpsonville, and Fountain Inn plants were certified
eligible to apply for adjustment assistance under petition number
TA-W-39,804, which expired January 2, 2004.
This investigation revealed that the preponderance in the
recent declines in employment at the subject firm is related to a
shift in production of electronic capacitors to a country (Mexico)
that is a party to a free trade agreement with the United States.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers’ firm or subdivision to Mexico of articles that
are like or directly competitive with those produced by the subject
firm or subdivision.
In accordance with the provisions of the Act, I make the
following certification:
"Workers of KEMET Electronics Corporation, Mauldin plant,
Simpsonville, South Carolina (TA-W-54,129), KEMET Electronics
Corporation, Simpsonville facility, Simpsonville, South
Carolina (TA-W-54,129A), and KEMET Electronics Corporation,
Fountain Inn plant, Fountain Inn, South Carolina (TA-W-
54,129B) engaged in employment related to the production of
ceramic or tantalum electronic capacitors, who became totally
or partially separated from employment on or after January 3,
2004 through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974; and
Workers of KEMET Electronics Corporation, Shelby Plant,
Shelby, North Carolina, including leased workers of Personnel
Services Unlimited, Shelby North Carolina (TA-W-54,129C)
engaged in employment related to the production of ceramic
sheet used to make ceramic electronic capacitors, who became
totally or partially separated from employment on or after
January 30, 2003 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
