Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on February
3, 2004, applicable to workers of Warnaco Group, Inc., Milford,
Connecticut and Stratford, Connecticut. The notice was published
in the Federal Register on March 12, 2004 (69 FR 11889).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in administration support activities for the subject
firm’s production facility located in Thomasville, Georgia.
New information shows that a worker separation occurred
involving an employee of the Milford, Connecticut facility of
Warnaco Group located in the state of Florida. This employee
provided administrative support function services for the
production of women’s intimate apparel at the Thomasville,
Georgia location of the subject firm.
Based on these findings, the Department is amending this
certification to include an employee of the Milford, Connecticut
facility of Warnaco Group, Inc. located in the state of Florida.
The intent of the Department’s certification is to include
all workers of Warnaco Group, Inc. who were adversely affected by
increased imports.
The amended notice applicable to TA-W-53,854 is hereby
issued as follows:
"All workers of Warnaco Group, Milford, Connecticut
(TA-W-53,854), including an employee located in the
state of Florida (TA-W-53,854B), who became totally or
partially separated from employment on or after
December 18, 2002, through February 3, 2006, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."

Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated in response to a petition
received on December 22, 2003, and filed by a State agency official
on behalf of workers at Warnaco Group, Inc., Milford, Connecticut
(TA-W-53,854) and Warnaco Group, Inc., Stratford, Connecticut (TA-
W-53,854A). Workers at both facilities were engaged in production
support and administration activities such as research and
development, inventory management, quality control, cost accounting
and purchasing.
The workers provided direct support to Warnaco Group, Inc.,
Intimate Apparel, Thomasville, Georgia, an affiliated facility
whose workers were certified eligible to apply for trade adjustment
assistance on March 25, 2003 (TA-W-50,610).
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met.
The Department has determined that for both of the Warnaco
Group, Inc., facilities the requirements of Section 246 have been
met.
A significant number of workers at the subject facilities are
age 50 or over and possess skills that are not easily
transferable. Competitive conditions within the industry are
adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with women’s underwear (bras, slips,
panties and girdles) produced at Warnaco Group, Inc., Intimate
Apparel Division, Thomasville, Georgia, contributed importantly to
the total or partial separation of workers at Warnaco Group, Inc.,
Milford, Connecticut and Warnaco Group, Inc., Stratford,
Connecticut. In accordance with the provisions of the Act, I make
the following certification:
"All workers of Warnaco Group, Inc., Milford, Connecticut (TA-
W-53,854), and Stratford, Connecticut (TA-W-53,854A), who
became totally or partially separated from employment on or
after December 18, 2002 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
