Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on February
3, 2004, applicable to workers of Facemate Corporation, Chicopee,
Massachusetts. The notice was published in the Federal Register
on March 12, 2004 (69 FR 11889).
At the request of a State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of textile interlinings.
Information shows that worker separations occurred at the
New York, New York location of the subject firm. The workers
provided sales and marketing functions for the subject firm’s
production facility located in Chicopee, Massachusetts.
Accordingly, the Department is amending the certification
to include workers of Facemate Corporation, Sales Office, New
York, New York.
The intent of the Department's certification is to include
all workers of Facemate Corporation who were adversely affected
by increased imports.
The amended notice applicable to TA-W-53,714 is hereby
issued as follows:
"All workers of Facemate Corporation, Chicopee,
Massachusetts (TA-W-53,714) and Facemate Corporation,
Sales Office, New York, New York (TA-W-54,714A), who
became totally or partially separated from employment
on or after December 1, 2002, through February 3, 2006,
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results of
its investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on December 4, 2003, in
response to a petition filed on behalf of workers at Facemate
Corporation, Chicopee, Massachusetts. The workers at the subject
firm produced textile interlinings.
The investigation revealed that sales, production, and
employment at the subject firm decreased from 2002 to 2003.
Moreover, the subject firm closed in December 2003.
The investigation further revealed that the subject firm did
not import textile interlinings or shift production to a foreign
country during the relevant period.
The Department of Labor surveyed the subject firm’s major
declining customers regarding their purchases of textile
interlinings during the period from 2002 to 2003. The survey
revealed increases in imports during the period under
investigation.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with textile interlinings produced at
the subject firm by the subject firm’s major customer contributed
importantly to the total or partial separation of workers and to
the decline in sales or production at that firm or subdivision. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of Facemate Corporation, Chicopee, Massachusetts
who became totally or partially separated from employment on
or after December 1, 2002, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
