Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results of
its investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on November 18, 2003, in
response to a petition filed by a company official on behalf of
workers of Marathon Oil Company (MOC). Workers at MOC, Corporate
Headquarters, Houston, Texas (TA-W-53,559) are engaged in domestic
and foreign oil and gas production and support of MOC domestic and
foreign operations. Workers at MOC, Alaska Production Region,
Anchorage, Alaska (TA-W-53,559A); MOC, Rocky Mountain Operations,
Cody, Wyoming (TA-W-53,559D); MOC, Mid-Continent Production Region,
Midland, Texas (TA-W-53,559Q); and MOC, Central Production Region,
Oklahoma City, Oklahoma (TA-W-53,559R) are engaged in oil and gas
production and exploitation and support activities. Workers at
MOC, Southern Production Region, Brenham, Texas (TA-W-53,559B);
MOC, Rocky Mountain Operations, Grass Creek, Wyoming (TA-W-
53,559G); MOC, Highlands Ranch, Colorado (TA-W-53,559H); MOC, Mid-
Continent Production Region, Hobbs, New Mexico (TA-W-53,559I); MOC,
Mid-Continent Production Region, Iraan, Texas (TA-W-53,559L); MOC,
Southern Production Region, Kilgore, Texas (TA-W-53,559M); MOC,
Gulf Coast Production Region, Lafayette, Louisiana (TA-W-53,559N);
MOC, Lindsay, Oklahoma (TA-W-53,559O); MOC, Rocky Mountain
Operations, Oregon Basin, Wyoming (TA-W-53,559S); MOC, Southern
Production Region, Tyler, Texas (TA-W-53,559T); MOC, Central
Production Region, Wheatland, Oklahoma (TA-W-53,559V); and MOC,
Watonga, Oklahoma (TA-W-53,559Y) are engaged in oil and gas
operations. Workers at MOC, Findlay, Ohio (TA-W-53,559F); MOC,
Aviation, Houston, Texas (TA-W-53,559K); and MOC, Washington,
District of Columbia (TA-W-53,559U) are in support of workers at
all other facilities.
The investigation revealed that sales and employment at the
subject facility decreased absolutely from 2001 to 2002 and during
the period of January through October 2003 when compared to the
same period in 2002.
The investigation revealed that aggregate U.S. imports of
crude petroleum were significant and increasing during the period
under investigation.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In addition, in order for the Department to issue a
certification of eligibility to apply for ATAA, the group
eligibility requirements of Section 246 of the Trade Act must be
met. The Department has determined in this case that the
requirements of Section 246 have been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with those produced at the subject
firm contributed importantly to the total or partial separation of
workers and to the decline in sales or production and at that firm
or subdivision. In accordance with the provisions of the Act, I
make the following certification:

(TA-W-53,559Y) who became totally or partially separated from
employment on or after October 31, 2002, through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”
