Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on December 12, 2003,
applicable to workers of New River Industries, Inc. located in
Radford, Virginia. The notice will soon be published in the
Federal Register.
At the request of a petitioner, the Department reviewed the
certification for workers of the subject firm. The workers
produce broadwoven fabric.
The petitioner indicates that some workers separated from
employment at the subject firm, prior to becoming permanent
employees of New River Industries in Radford, Virginia, were
working at the plant through a temporary employment service
agency, Southern Employment.
The intent of the Department's certification is to provide
coverage to all workers at New River Industries, Radford,
Virginia, who were adversely affected increases in imports.
Therefore, the Department is amending the certification to
include temporary workers at the subject firm whose wages were
reported to Southern Employment.
The amended notice applicable to TA-W-53,324 is hereby
issued as follows:
"All workers of New River Industries, Inc., Radford,
Virginia, and temporary workers of Southern Employment
engaged in employment related to the production of
broadwoven fabric at New River Industries, Inc., Radford,
Virginia, who became totally or partially separated from
employment on or after October 15, 2002, through December
12, 2005, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and alternative
trade adjustment assistance under Section 246 of the Trade
Act of 1974, as amended."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
And Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273), as amended, the Department of Labor herein presents the results of its investigation regarding certification of eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for Trade Adjustment Assistance, the group eligibility requirements in either paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met. It is determined in this case that the requirements of (a)(2)(A) of Section 222 have been met.
The investigation was initiated on October 23, 2003 in response to a petition filed by the company on behalf of workers at New River Industries, Inc., Radford, Virginia (TA-W-53,324) and New River Industries, Inc., New York, New York (TA-W-53,324A).
Workers at New River Industries, Inc., Radford, Virginia (TA-W-53,324) produced broadwoven fabric. The workers at New River Industries, Inc., New York, New York (TA-W-53,324A) provide administrative support for workers in the Radford, Virginia office
The investigation revealed that sales, production and employment declined at the subject facilities during the relevant period.
The Department of Labor surveyed the subject firm’s major customers regarding their purchases of broadwoven fabric. The survey revealed that the subject firm customers increased their reliance on imported broadwoven fabric during the period under investigation.
The petitioner also requested consideration for Alternative Trade Adjustment Assistance (ATAA).
In order to issue a certification of eligibility to apply for ATAA for older workers, the group eligibility requirements of Section 246(a)(3)(A)(ii) of the Trade Act must be met. The Department has determined in this case that the requirements have been met.
A significant number of workers at the firm are age 50 or over and possess skills that are not easily transferable. Competitive conditions within the industry are adverse.

Conclusion
After careful review of the facts obtained in the investigation, I conclude that increases of imports of articles like or directly competitive with broadwoven fabric produced at New River Industries, Inc., Radford, Virginia (TA-W-53,324) and New River Industries, Inc., New York, New York (TA-W-53,324A) contributed importantly to the total or partial separation of workers and to the decline in sales or production at that firm or subdivision. In accordance with the provisions of the Act, I make the following certification:
"All workers of New River Industries, Inc., Radford, Virginia (TA-W-53,324) and New River Industries, Inc., New York, New York (TA-W-53,324A) who became totally or partially separated from employment on or after October 15, 2002 through two years from the date of certification are eligible to apply for adjustment assistance under Section 223, and alternative trade adjustment assistance under Section 246 of the Trade Act of 1974."
