Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on October
24, 2003, applicable to workers of Planar Systems, Inc., Medical
Business Unit, Waltham, Massachusetts. The notice was published in
the Federal Register on November 28, 2003 (68 FR 66878-68779).
At the request of accompany official, the Department reviewed
the certification for workers of the subject firm. The workers
produce flat panel displays and related products.
New information shows that in April 2002, Planar Systems, Inc.
purchased Dome Imaging Systems located in Waltham, Massachusetts.
Workers separated from employment at the Waltham, Massachusetts
location of the subject firm had their wages reported under the
separate Unemployment Insurance (UI) tax account for Dome Imaging
Systems.
Accordingly, the Department is amending the certification to
properly reflect this matter.


The intent of the Department's certification is to include all
workers of Planar Systems, Inc. who were adversely affected by
increased company imports.
The amended notice applicable to TA-W-53,039A is hereby issued
as follows:
"All workers of Planar Systems, Inc. Medical Business Unit,
Dome Imaging Systems, Waltham, Massachusetts (TA-W-53,039A),
who became totally or partially separated from employment on
or after September 23, 2002, through October 24, 2005, are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated in response to a petition
initiated on September 29, 2003 and filed by a company official on
behalf of workers at three closely associated facilities of Planar
Systems, Inc., Beaverton, Oregon (TA-W-53,039), and at Planar
Systems, Inc., Medical Business Unit, Waltham, Massachusetts (TA-W-
53,039A).
The workers at Planar Systems, Inc., Beaverton, Oregon (TA-W-
53,039) do assembly and finishing work for displays and monitors,
and are not separately identifiably by product line; It is
determined that that the requirements of (a)(2)(A) of Section 222
have been met.
The investigation revealed that production and employment
declined at the subject facilities in Beaverton from fiscal year
2002 to fiscal year 2002.
Imports of flat panel displays and monitors by the subject
firm increased during the relevant time period.
The workers at Planar Systems, Inc., Waltham, Massachusetts
(TA-W-53,039A) produce flat panel displays and related products,
and are not separately identifiable by product line; It is
determined that that the requirements of (a)(2)(A) of Section 222
have been met.
The investigation revealed that sales and employment declined
at the subject firm from January through September 2002 compared to
the same period in 2003.
Imports of flat panel displays and related products by the
subject firm increased during the relevant time period.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with flat panel displays and related
products, and monitors produced at Planar Systems, Inc. contributed
importantly to the total or partial separation of workers and to
the decline in sales or production and at that firm. In accordance
with the provisions of the Act, I make the following certification:
“All workers of Planar Systems, Inc., Beaverton, Oregon (TA-W-
53,039), and all workers of Planar Systems, Inc., Medical
Business Unit, Waltham, Massachusetts (TA-W-53,039A) who
became totally or partially separated from employment on or
after September 23, 2002 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974.”
