Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on
September 22, 2003, applicable to workers of Solutia, Inc., Nylon
Business Unit, including leased workers of Kelly Services and
Austin Industrial, Decatur, Alabama. The notice was published in
the Federal Register on November 6, 2003 (68 FR 62834).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers of the firm produce acrylic fibers and chemicals at its
Decatur, Georgia plant. New information provided by the company
shows that since the date on which the certification was issued,
Solutia, Inc., Nylon Business Unit, entered into a leased worker
arrangement with The Mundy Companies.
Based on this new information, the Department is amending
the certification to include leased workers of The Mundies
Companies engaged in activities related to the production of
working at Solutia, Inc., Nylon Business Unit, Decatur, Alabama.
The intent of the Department's certification is to include
all workers of Solutia, Inc., Nylon Business Unit, who were
adversely affected by increased imports.
The amended notice applicable to TA-W-52,517 is hereby
issued as follows:
"Workers of Solutia, Inc., Nylon Business Unit,
including leased workers of Kelly Services, Austin
Industrial and The Mundy Companies, Decatur, Alabama,
engaged in employment related to the production of
acrylic fibers, Decatur, Alabama, who became totally or
partially separated from employment on or after August
5, 2002, through September 22, 2005, are eligible to
apply for adjustment assistance under Section 223 of
the Trade Act of 1974.”

Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirement of
paragraph (b) of Section 222 of the Trade Act must be met. It is
determined in this case that the requirements of (b) of Section
222, have been met.
The investigation was initiated on August 11, 2003 in
response to a petition filed by a company official on behalf of
workers at Solutia, Inc., Nylon Business Unit, including leased
workers from Kelly Services and Austin Industrial, Decatur,
Alabama. The workers at the subject facility produce acrylic
fibers and chemicals; they are separately identifiable by product
line.
The investigation revealed that Solutia, Inc., Nylon Business
Unit, Decatur, Alabama, supplies at least 20 percent of its
production or sales of acrylic fibers a manufacturer of yarn whose
workers were certified eligible to apply for adjustment assistance.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers engaged in the production
of acrylic fibers at Solutia, Inc., Nylon Business Unit, Decatur,
Alabama, qualify as adversely affected secondary workers under
Section 222 of the Trade Act of 1974. In accordance with the
provisions of the Act, I make the following certification:
“Workers of Solutia, Inc., Nylon Business Unit, Decatur,
Alabama, engaged in employment related to the production of
acrylic fibers, and leased workers of Kelly Services and
Austin Industrial, producing acrylic fibers at Solutia, Inc.,
Nylon Business Unit, Decatur, Alabama, who became totally or
partially separated from employment on or after August 5,
2002, through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
