Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
the group eligibility requirements under Section 222(b) must be
met. It has been determined in this case that the requirements of
Section 222(b) are met.
The investigation was initiated on August 5, 2003 in response
to a petition filed by a company official on behalf of workers of
F/V Alert, State of Alaska Commercial Fisheries Entry Commission
Permit #S01A62650N, Veronia, Oregon. The workers of the subject
group produced fresh and chilled salmon.
During the period of July through December 2002, sales of
fresh and chilled salmon by the subject group decreased absolutely
when compared to the same period one year prior. The subject group
did not fish during the period of January through June of 2003.
The investigation revealed that F/V Alert, Veronia, Alaska, is
an upstream supplier of fresh and chilled salmon to a processor
whose workers were certified eligible to apply for trade adjustment
assistance and who accounted for at least 20 percent of the sales
of the subject group.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of F/V Alert, Veronia,
Oregon, qualify as adversely affected secondary workers.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Fishing Vessel Alert, Veronia, Oregon who
became totally or partially separated from employment on or
after July 22, 2002, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
