Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on June 18, 2003 in response
to a petition filed by a company official on behalf of workers at
MKS Instruments, Inc., Medical Electronics Division, Colorado
Springs, Colorado. The workers at the subject firm produce power
amplifiers and generators utilized in the medical industry.
The investigation revealed that employment at the subject firm
decreased from January to June, 2003 when compared to the same
period in 2002.
Furthermore, the investigation revealed that the preponderance
of declines in employment at the subject firm is related to a shift
in production of power amplifiers and generators utilized in the
medical industry to China.
Moreover, the Department of Labor has determined that imports
of power amplifiers and generators utilized in the medical industry
are likely to increase.
Other findings of the investigation show that some of the
workers wages were reported to the Unemployment Insurance tax
account for ETO, Inc.
The investigation revealed that MKS Instruments, Inc., Medical
Electronics Division, Colorado Springs, Colorado leases production
workers from Adecco, Volt and Kelly Services.















Conclusion
After careful review of the facts obtained in the
investigation, I conclude that a shift in production of articles
like or directly competitive with power amplifiers and generators
produced at MKS Instruments, Inc., Medical Electronics Division,
Colorado Springs, Colorado contributed to the total or partial
separation of workers at that firm.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of MKS Instruments, Inc., ETO, Inc., Medical
Electronics Division, Colorado Springs, Colorado, and leased
workers of Adecco, Volt and Kelly Services, engaged in
production of power amplifiers and generators at MKS
Instruments, Inc., Medical Electronics Division, Colorado
Springs, Colorado who became totally or partially separated
from employment on or after June 17, 2002 through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
