Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
the group eligibility requirements under Section 222(b) must be
met. It has been determined in this case that the requirements of
Section 222(b) are met.
The investigation was initiated on June 17, 2003 in response
to a petition filed by a company official on behalf of workers of
F/V Alta E, State of Alaska Commercial Fisheries Entry Commission
Permit #S15B56568P, Point Baker, Alaska. The workers of the
subject group produce fresh and chilled salmon.
During the period of April 2002 through March 2003, sales and
employment of the subject group decreased absolutely when compared
to the same period one year prior.
The investigation revealed that F/V Alta E, Point Baker,
Alaska, is an upstream supplier of fresh and chilled salmon to a
processor whose workers were certified eligible to apply for trade
adjustment assistance based on increased customer imports and who
accounted for at least 20 percent of the sales of the subject
group.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases in imports of processed
salmon, contributed importantly to the total or partial separation
of workers of F/V Alta E, Point Baker, Alaska.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Fishing Vessel Alta E, Point Baker, Alaska,
who became totally or partially separated from employment on
or after May 6, 2002, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
