Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on June 16,
2003, applicable to workers of Advanced Energy Industries, Core
Manufacturing, Fort Collins, Colorado. The notice was published
in the Federal Register on July 3, 2003 (68 FR 39977).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. Information
provided by the company shows that leased workers of Adecco
Staffing were employed at Advanced Energy Industries, Core
Manufacturing to produce printed circuit board assemblies at the
Fort Collins, Colorado location of the subject firm.
Based on these findings, the Department is amending this
certification to include leased workers of Adecco Staffing, Fort
Collins, Colorado employed at Advanced Energy Industries, Core
Manufacturing, Fort Collins, Colorado.
The intent of the Department's certification is to include
all workers of Advanced Energy Industries, Core Manufacturing who
were adversely affected by the shift in production to China and
Malaysia.
The amended notice applicable to TA-W-51,836 is hereby
issued as follows:
"All workers of Advanced Energy Industries, Core
Manufacturing, Fort Collins, Colorado including leased
workers of Adecco Staffing, Fort Collins, Colorado
engaged in employment related to the production of
printed circuit board assemblies at Advanced Energy
Industries, Core Manufacturing, Fort Collins, Colorado,
who became totally or partially separated from
employment on or after May 13, 2002, through June 16,
2005, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on May 21, 2003, in response
to a petition filed on behalf of workers of Advanced Energy
Industries, Core Manufacturing, Fort Collins, Colorado. The workers
produced printed circuit board assemblies.
The investigation revealed that the company is in the process
of shifting plant production from the subject facility to foreign
countries. The company plans to import as a result of the shift
in production. Layoffs due to the shift will begin on June 30,
2003.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers’ firm or subdivision to China and Malaysia of
articles that are like or directly competitive with those produced
by the subject firm or subdivision, and there has been or is likely
to be an increase in imports of like or directly competitive
articles. In accordance with the provisions of the Act, I make the
following certification:
"All workers of Advanced Energy Industries, Core
Manufacturing, Fort Collins, Colorado who became totally or
partially separated from employment on or after May 13, 2002
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974."
