Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on May 14, 2003 in response to
a petition filed on behalf of workers of Agilent Technologies,
Inc.'s Network Systems Test Division (NSTD). NSTD workers are
separately identifiable by location, function, and product line.
Workers at Colorado Springs, Colorado (TA-W-51,753)
manufacture PLPJ products and PLPW products. Workers at Englewood,
Colorado (TA-W-51,753A) produce PLPW products and are engaged in
Tier I, Tier II, and Tier III support. Workers at Loveland,
Colorado (TA-W-51,753B) are engaged in Tier III support. Workers
at Boxborough, Massachusetts (TA-W-51,753C); portsmouth, New
Hampshire (TA-W-51,753D); Andover, Massachusetts (TA-W-51,753E);
and Richardson, Texas (TA-W-51,753F) are engaged in research and
development of PLPW products. Workers at Santa Rosa, California
(TA-W-51,753G) and Santa Clara, California (TA-W-51,753C) are
engaged in research and development of PLPW products, Tier II
support, and marketing. Workers at Cypress, Texas (TA-W-51,753H)
were engaged in research and development of PLPW products. Workers
at Arlington Heights, Illinois (TA-W-51,753J) are engaged in
production of PLPW products and research and development of PLPW
products.
The preponderance in the declines in employment at the subject
division is related to a shift in production of PLPW products to a
country (Singapore) that is a party to a free trade agreement with
the United States.
Workers of Agilent Technologies, Network Systems and Test
Division, Colorado Springs, Colorado, were covered under a previous
certification, TA-W-39,042B, that expired May 25, 2003.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers' firm or subdivision to Singapore of articles that
are like or directly competitive with those produced by the subject
firm or subdivision. In accordance with the provisions of the Act,
I make the following certification:
"All workers of Agilent Technologies, Inc., Network Systems
Test Division in Colorado Springs, Colorado (TA-W-51,753)
engaged in employment related to the production and support of
PLPW products who became totally or partially separated from
employment on or after May 26, 2003 through two years from the
date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974;" and
"All workers of Agilent Technologies, Inc., Network Systems
Test Division in Englewood, Colorado (TA-W-51,753A); Loveland,
Colorado (TA-W-51,753B); Boxborough, Massachusetts (TA-W-
51,753C); Portsmouth, New Hampshire (TA-W-51,753D); Andover,
Massachusetts (TA-W-51,753E); Richardson, Texas (TA-W-
51,753F); Santa Rosa, California (TA-W-51,753G); Cypress,
Texas (TA-W-51,753H); Santa Clara, California (TA-W-51,753I);
and Arlington Heights, Illinois (TA-W-51,753J) engaged in
employment related to the production and support of PLPW
products who became totally or partially separated from
employment on or after May 12, 2002 through two years from the
date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
