Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated on April 23, 2003 in response to a
petition filed on behalf of workers at Spicer Driveshaft
Manufacturing, Inc., a division of the Dana Corporation, Lima,
Ohio. Workers at the subject firm produced fittings for drive
shaft assemblies.
The investigation revealed that all workers were separated
from the subject firm more than one year before the date of the
petition. Section 223(b)(1) of the Act specifies that no
certification may apply to any worker whose separation occurred
more than one year before the date of the petition. Consequently,
further investigation in this case would serve no purpose, and the
investigation has been terminated.

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated in response to a petition
received on April 25, 2003, and filed by United Automobile,
Aerospace and Agricultural Implement Workers of America (UAW),
Local 1765, on behalf of workers at Torque- Traction Manufacturing
Technologies Inc., formerly known as Spicer Driveshaft Mfg, Inc., a
division of Dana Corporation, Lima, Ohio.
Workers at the subject firm produce light duty end yokes; they
are separately identifiable by product line.
The investigation revealed that sales and employment at the
subject firm decreased from January through May of 2003 when
compared to the same period in 2002.
Furthermore, imports of light duty end yokes by the subject
firm increased absolutely from 2001 to 2002.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with light duty end yokes produced at
Torque- Traction Manufacturing Technologies Inc., formerly known as
Spicer Driveshaft Mfg, Inc., a division of Dana Corporation, Lima,
Ohio, contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Torque- Traction Manufacturing Technologies
Inc., formerly known as Spicer Driveshaft Mfg, Inc., a
division of Dana Corporation, Lima, Ohio, engaged in the
production of light duty end yokes, who became totally or
partially separated from employment on or after April 22,
2002, through two years from the date of certification, are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
