Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on May 28,
2003, applicable to workers of M. Wile Company, dba HMX Tailored,
located in Buffalo, New York. The notice was published in the
Federal Register on June 19, 2003 (68 FR 36845).
At the request of the State Agency, the Department reviewed
the certification for workers of the subject firm. The workers
produce men’s tailored clothing including men’s suit coats and
sport coats and cut fabric for men’s pants produced at other
company plants.
The review shows that the subject firm also does business
under the brand name, Intercontinental Branded Apparel. Workers
of Intercontinental Branded Apparel, Ellwood Avenue, Buffalo, New
were certified eligible to apply for worker adjustment assistance
under petition number TA-W-38,253, which expired February 21,
2003.
Therefore, in order to avoid an overlap in worker group
coverage, the Department is amending the February 21, 2002 impact
date established for TA-W-51,095, to read February 22, 2003.
The amended notice applicable to TA-W-51,095 is hereby
issued as follows:
"All workers of M. Wile Company, dba HMX Tailored,
Intercontinental Branded Apparel, Buffalo, New York, who
became totally or partially separated from employment on or
after February 22, 2003, through May 28, 2005, are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on March 7, 2003 in response
to a petition filed by Union of Needletrades, Industrial & Textile
Employees, Rochester Regional Joint Board, on behalf of workers of
M. Wile Company dba HMX Tailored, Buffalo, New York. The subject
firm is a subsidiary of Hartmarx Corporation. The workers produced
men’s tailored clothing including men’s suit coats and sport coats
and cut fabric for men’s pants produced at other company plants.
The investigation revealed that men’s suits, sport coats and
pants produced by M. Wile Company are marketed through normal
retail channels. Thus, the articles manufactured by the subject
firm have been impacted importantly by the high penetration of
imports into this market.
United States imports of men’s and boys’ suits increased
absolutely and relative to U.S. shipments in the twelve-month
period ending September 2002 compared to the same period one year
earlier. In the twelve-month period ending September 2002 the
ratio of imports to domestic production was more than 146 percent.
United States imports of men’s and boys’ trousers, slacks,
jeans and pants increased absolutely in the twelve-month period
ending September 2002 compared to the same period one year earlier.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with men’s suit coats, sport coats and
pants produced at M. Wile Company dba HMX Tailored, Buffalo, New
York contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make
the following certification:


"All workers of M. Wile Company dba HMX Tailored, Buffalo, New
York who became totally or partially separated from employment
on or after February 21, 2002 through two years from the date
of certification are eligible to apply for adjustment assis-
tance under Section 223 of the Trade Act of 1974."
