Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on February 25, 2003, in
response to a petition filed on behalf of workers of IMCO Recycling
of Idaho, Post Falls, Idaho. The workers produced secondary
aluminum ingots.
The investigation revealed that IMCO Recycling of Idaho,
Post Falls, Idaho produces secondary aluminum ingots which it
supplies to manufacturers of primary aluminum, and a loss of
business with this/these manufacturer(s) contributed importantly
to the workers separation or threat of separation.
Evidence revealed that Kaiser Aluminum & Chemical
Corporation, Trentwood, Washington to whom the petitioning
workers' firm or subdivision supplies secondary aluminum ingot,
employed a group of workers who received a certification of
eligibility for adjustment assistance, and such supply or
production is related to the article that was the basis for such
certification. Kaiser Aluminum-Trentwood was affected by import
penetration of aluminum plate and sheet while reducing its
purchases of secondary aluminum ingot from the petitioning
workers' firm. The subject firm's employment declined, in part,
because of the imports of aluminum plate and sheet. Workers of
Kaiser Aluminum & Chemical Corporation, Trentwood, Washington
were certified as eligible to apply for trade adjustment
assistance on March 12, 2002 (TA-W-40,493B).
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of IMCO Recycling of Idaho,
Post Falls, Idaho qualify as adversely affected secondary workers
under Section 222 of the Trade Act of 1974, as amended. In
accordance with the provisions of the Act, I make the following
certification:


"All workers of IMCO Recycling of Idaho, Post Falls, Idaho who
became totally or partially separated from employment on or
after February 14, 2002, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, as amended"
