Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on March
10, 2003, applicable to workers of Shadowline, Incorporated,
Morganton, North Carolina. The notice will soon be published in
the Federal Register.
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers produced lingerie. Information contained in the record
shows that the company intended workers in Boone, North Carolina
to be included in the certification. The workers at both North
Carolina locations are considered by the company as one worker
group. Data collected from the company official were for both
locations.
It is the Department’s intent to include all workers of
Shadowline, Incorporated, adversely affected by increased
imports. Accordingly, the Department is amending the
certification to include all workers of Shadowline, Incorporated,
located in Boone, North Carolina.
The amended notice applicable to TA-W-50,934 is hereby
issued as follows:
"All workers of Shadowline, Incorporated, Morganton, North
Carolina (TA-W-50,934) and Boone, North Carolina (TA-W-
50,934A), who became totally or partially separated from
employment on or after February 11, 2002, through March 10,
2005, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 SC
2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated February 24, 2003 in response
to a petition filed by a company official on behalf of workers at
Shadowline, Incorporated, Morganton, North Carolina. The workers at
the subject firm produce lingerie. Workers are not separately
identifiable by product line.
The investigation revealed that sales, production and
employment at the subject firm decreased from 2001 to 2002. The
subject firm is continuing to shift production of lingerie to
Mexico and will likely increase imports.



Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with lingerie produced at Shadowline,
Incorporated, Morganton, North Carolina contributed importantly to
the total or partial separation of workers and to the decline in
sales or production and at that firm or subdivision. In accordance
with the provisions of the Act, I make the following certification:
"All workers of Shadowline, Incorporated, Morganton, North
Carolina who became totally or partially separated from
employment on or after February 11, 2002 through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
