Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued Amended Certification
Regarding Eligibility to Apply for Worker Adjustment Assistance
on April 25, 2003, applicable to workers of the Cannondale
Corporation, Bicycle Plant, Bedford, Pennsylvania. The notice
was published in the Federal Register on May 9, 2003
(68 FR 25060).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of bicycles, clothing and
accessories.
New information shows that Cannondale Corporation, Bicycle
Plant became known as Cannondale Bicycle Corporation in May 2003
following bankruptcy in early 2003. Workers separated from
employment as the subject firm had their wages reported under a
separated unemployment insurance (UI) tax account for Cannondale
Bicycle Corporation.


Accordingly, the Department is amending this certification
to properly reflect this matter.
The intent of the Department’s certification is to include
all workers of Cannondale Corporation, Bicycle Plant who were
adversely affected by increased imports.
The amended notice applicable to TA-W-50,878 is hereby
issued as follows:
"All workers of Cannondale Corporation, Bicycle Plant, now
known as Cannondale Bicycle Corporation, Bedford,
Pennsylvania, who became totally or partially separated from
employment on or after February 10, 2002, through April 25,
2005, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met. It is determined in this case that the requirements
of (a)(2)(A) of Section 222 have been met.
The investigation was initiated in response to a petition
received on February 13, 2003 and filed by a company official on
behalf of workers at Cannondale Corporation, Bicycle Plant,
Bedford, Pennsylvania. The workers produced bicycles, clothing
and accessories.
The investigation revealed that subject plant sales,
production and employment declined during the relevant period.


The investigation further revealed that the company
increased its reliance on imports of clothing and accessories
during the relevant period.
The Department of Labor conducted a survey of the subject
firm's major declining customers regarding their purchases of
bicycles, clothing and accessories during 2001, 2002 and January
through February 2003 over the corresponding 2002 period. The
survey revealed that major customers increased their purchases of
imported bicycles (primary product), while decreasing their
purchases from the subject firm during the relevant period.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with bicycles, clothing and
accessories produced at Cannondale Corporation, Bicycle Plant,
Bedford, Pennsylvania contributed importantly to the total or
partial separation of workers and to the decline in sales or
production and at that firm or subdivision. In accordance with
the provisions of the Act, I make the following certification:




"All workers of Cannondale Corporation, Bicycle Plant,
Bedford, Pennsylvania who became totally or partially
separated from employment on or after February 10, 2002
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974, as amended."
